Rakib (Rejected) CRM (NDPS) 644 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station case no. 30 of 2026 dated 06.01.2026 under Sections 21(c)/25/27A/29 of the NDPS Act. And In the matter of : Rinku Sk. ……Petitioner. Mr. Abhimanyu Bannerjee Mr. Arnab Saha .....for the Petitioner. Mr. Md. Adil Badr, Jr. Govt. Adv, Ms. Rita Datta ……for the State. The subject matter of the case relates to alleged recovery of 112 bottles Eskuf cough syrup. Learned advocate submits that there was no recovery from the possession of the present petitioner and as such the petitioner may be released on bail. On the other hand learned advocate for the State opposes the prayer for bail and submits that the investigation of the case is still in progress and pursuant to the leading statement of the present petitioner there were recovery of contraband. Having considered that the investigation of the case is still in progress, I am not inclined to release the petitioner on bail. However, the petitioner would be at liberty to renew his prayer for bail after the charge-sheet is submitted before the jurisdictional Court. 2 Accordingly, CRM (NDPS) 644 of 2026 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
