1. Mr. Ravi Bisht, learned counsel for the petitioner.
2. Mr. Ghanshyam Joshi, learned Additional C.S.C. for the State of Uttarakhand.
3. Mr. Pankaj Chaturvedi, learned Central Government Standing Counsel for respondent no. 2.
4. Petitioner has applied for issuance of passport. His application is not being considered for the reason that there is some criminal case pending against him.
5. It is contended by learned counsel for the petitioner that even though petitioner was convicted and sentenced for an offence punishable under Sections 323, 147, 325, 504, 506 & 427 IPC, however, the conviction and sentence, recorded by leaned trial court, is under challenge in a criminal revision, which is pending before coordinate Bench of this Court. It is submitted that since appeal/revision is continuation of trial, therefore, petitioner cannot be held to be guilty till dismissal of his criminal revision. He submits that Regional Passport Officer is under a duty to

2026:UHC:7151 consider petitioner’s application in a dispassionate manner.
6. Mr. Pankaj Chaturvedi,
learned counsel appearing for Regional Passport Officer submits that since petitioner has made application, therefore, the Competent Authority shall take decision thereupon, as per law.
7. The writ petition is, accordingly,
disposed of with a direction to Regional Passport Officer to take decision on petitioner’s application dated 05.08.2026, as per law, within four weeks from the date of presentation of certified copy of this order.
