This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely, Sams Uddin, has prayed for bail in connection with Sribhumi P.S. Case No. 483/2025 under Section 80(2) of BNS, 2023. 3. The accused was arrested on 07.11.2025 in connection with this case which was registered on the basis of an FIR dated 06.11.2025 lodged by the brother of the deceased. The deceased was the wife of the petitioner and the allegation is that the petitioner and his family members tortured her and that eventually, she expired and it is suspected that the petitioner killed the informant’s sister. There is also allegation that the accused demanding dowry from the family members of the victim. 4. It is submitted by the learned counsel for the petitioner that the petitioner and the deceased have a 13(thirteen) months old daughter. It is also submitted that the petitioner has completed 84 days in custody. It is submitted that as per his instruction, there is no previous criminal case lodged against the petitioner with regard to the allegation of dowry demand. It is further submitted that the petitioner had taken the victim to the hospital and the same is also reflected in the statement recorded during investigation. 5. The case diary is received. 6. The learned Additional Public Prosecutor for the State submits that FSL report is not available. He has drawn my attention to the statement of Faruk Ahmed recorded during investigation and the said witness has stated that persuaded the victim to come back to the matrimonial home after she went back in connection with alleged illicit affair of her husband. 7. I have seen the progress of investigation. It is stated that the investigation remains pending for FSL report. It appears that other parts of the investigation are over. 8. In the facts and circumstances and considering the length of detention as on date – I am of the considered view that he can be released on bail at this stage, subject to conditions. 9.
Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Sribhumi P.S. Case No. 483/2025 under Section 80(2) of BNS, 2023, on furnishing bail bond of Rs.50,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court(CJM, Sribhumi). 10. The direction for bail is further subject to the following conditions: (a) That the petitioner shall be available for trial, if one commences; (b) That the petitioner shall not hamper or tamper with evidence; and (c) That the petitioner shall not try to influence any witnesses;
11. Violation or breach of any condition(s) shall entail cancellation of bail. 12. With the above observations, this bail petition stands allowed and
disposed of accordingly.
