The present Writ Petition has been filed seeking the following reliefs:- “(i) Issue a writ order or direction in the nature of mandamus commanding the respondent no. 2 to 4 to provide immediate and effective police protection to the petitioners and their family members so that they may safely returned to, reside in, and peaceful settled in their native village/Home Village (Bairagiwala), P.S. Sahaspur, Tehsil Vikasnagar, Dehradun for their peaceful residence. (ii) Issue a writ order or direction in the nature of mandamus commanding the respondent no. 2 to 4 to ensure that no private person, mob or caste group obstruct, threaten, assault, boycott and prevent the petitioners and their family members from entering, residing or rebuilding/repairing their homes in the village. (iii) Issue a writ order or direction in the nature of mandamus commanding the local authorities not to demolish, dispossess, seal or interfere with the petitioners residential houses accept strictly in accordance with law, after prior notice; opportunity of hearing and the reasoned order passed by the competent authority. (iv) Issue a writ order or direction in the nature of mandamus commanding the respondent nos. 2 and 3 to consider and decide the petitioners pending representation dated 21.07.2026 within fixed time framed and to pass protection order.” 4. The case of the petitioner is that an incident took place on 13.06.2026, which was given communal colour and residential house of the petitioner was damaged and demolished by the erring mob and feeling threat to the life and liberty, the petitioners fled from the said village. Now, they want to return to the said village and have thus sought protection. 5. On the last date, State was directed to get instructions. 6. Today, on instructions, learned State Counsel submits that to maintain peace and order, police force has been deployed in the village Beragiwala. Besides this, S.H.O. concerned has also assessed the threat perception to the petitioners and their family members and has found that at present, there is no threat to the petitioners. It is also submitted by learned State Counsel that some of the families have returned back in the village and are living there. Learned State Counsel has supplied the Written instructions. The same is taken on record. 7. Considering all these facts and also considering the submissions advanced by learned State Counsel, the writ petition stands disposed of.
