In the earlier order while disposing of the bail application, this Court directed for examination of the seizure list witnesses. Such order was passed on 21.01.2026. There is nothing on record that prior to 17.03.2026, such order was placed before the learned Special Court. One of the witnesses happens to be the informant and other happens to be a witness to the seizure. Petitioner is in custody for more than ten months. It has been informed on behalf of the State that next date has been fixed on and from 02.05.2026. If it is not possible for the learned Special Court to complete the evidence of Surajit Banik and Raju Biswas, two witnesses who have been cited amongst others in the seizure list, 2 learned Special Court within a period of 45 days from the said schedule, complete the evidence of the said witnesses. At this stage, the prayer for bail of the petitioner is rejected. Petitioner will renew his prayer for bail after the evidence of the said witnesses is over. The application for bail, being CRM (NDPS) 744 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
