Plot No.355 within Mouza-Jhalda, J.L. No.131 in the District of Purulia has been utilised without initiating any proceeding for acquisition. Petitioner submitted a representation before the Block Development Officer and pursuant to an order passed by a Co-ordinate Bench in WPA 6685 of 2021, the Block Development Officer passed an order dated April 28, 2023 and May 12, 2023. It appears from the said order that the Office of the B.D.O. was constructed in the year 1956 after acquisition of a piece of land by virtue of a Bihar Gazette Notification on July 11, 1956. The Block Development Officer has rightly observed that such authority is not the appropriate authority to determine whether the petitioners are eligible to any compensation or not. Faced with such situation, Mr. Acharya, learned advocate appearing for the petitioner submits that after the Block Development Officer passed the aforesaid orders, 2 the petitioner submitted a representation dated August 6, 2023 before the Special Land Acquisition Officer, Purulia. Mr. Acharya submits that the said respondent be directed to consider the representation of the petitioner and to dispose of the same in accordance with law. Without entering into the merits of the claim made by the petitioner in the representation dated August 6, 2023, WPA 24814 of 2023 stands disposed of by directing the Special Land Acquisition Officer, Purulia, being the respondent No.4 to consider the representation of the petitioner dated August 6, 2023 and dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner or his authorised representative and communicate the reasoned order to the petitioner as expeditiously as possible but positively within a period of 4 months from the date of receipt of a server copy of this order. It will be open to the petitioner to place reliance upon any orders/notifications etc. at the time of hearing in support of his claim for compensation. If such materials are relied upon, the said authority shall consider the same and pass order in accordance with law. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
