1. Mr. Gaurav Singh, learned counsel for the applicant. 2. Mr. Pratiroop Pandey, learned AGA for the State. 3. The instant bail application is moved by the applicant “Pravesh Sabari, son of Jameel Ahmed”, seeking regular bail in reference to FIR dated 23.12.2022 bearing FIR No. 634 of 2022 registered at Police Station – Ranipur, District – Haridwar wherein present applicant along with Arun Sharma, Vinit Kumar, Lalit Mohan Sharma and Mukesh Ram have been implicated for the offences punishable under Section 419, 420, 467, 468, 471 of BNS, 2023 and now on completion of the investigation they have been chargesheeted for the offences punishable under Section 419, 420, 467, 468, 471, 120B of BNS, 2023. 4. It is argued by the learned counsel for the applicant that applicant is innocent and has been falsely implicated and is languishing in jail since 03.09.2025 i.e. for almost 11 months and has no previous criminal history and charge sheet has already been filed, therefore, there is no need of further custodial interrogation. He further submits that co- accused Lalit Mohan Sharma has already been enlarged on bail by the Trial Court and all the offences are triable by Magistrate. 5. On the other side, learned State Counsel have not disputed that co-accused has already been enlarged on bail by the trial court and applicant is languishing in jail since 03.09.2025 and he has no criminal antecedents and all the offences are triable by Magistrate. After hearing the learned counsel for the parties and taking into consideration that co-accused Lalit Mohan Sharma has already been enlarged on bail by the Trial Court and applicant is languishing in jail since 03.09.2025 and has no criminal antecedents and all the offences are triable by Magistrate and charge sheet has already been filed, this Court is of the view that applicant deserves for bail
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8.
Let the applicant “Pravesh Sabari, son of Jameel Ahmed” be released on bail on furnishing his personal bond and two sureties, each of the like amount to the satisfaction of the court concerned subject to the following conditions: i. He shall join Trial Court proceeding on each and every date without seeking any unnecessary adjournment. ii. He shall not temper with the evidence. iii. He shall not indulge in any such activity and will also not leave the country without prior permission of the Trial Court. (Rakesh Thapliyal, J.) 12.08.2026 SKS
