It is the grievance of the petitioner that dismissal order of the petitioner vide Memo No. 474 dated 08.04.2025 passed by the Deputy Development Commissioner cum Chief Executive Officer, Zila Parishad, Chatra has been set aside by the Commissioner North Chhotanagpur Division, Hazaribag in Service Appeal No. 27 of 2025. It is the submission that after setting aside the order of 2026:JHHC:241 2 dismissal the Deputy Commissioner was directed to consider the case of the petitioner afresh but till date the Deputy Commissioner has not taken any decision after giving opportunity of hearing to the petitioner nor the petitioner was allowed to join. 3. Learned counsel for the respondent-Zila Parishad and the learned counsel for the State submits that the case of the petitioner would be considered by the Deputy Commissioner at the earliest. 4. Considering the said submission, I direct the respondent no. 5 - the Deputy Commissioner, Chatra to decide the matter afresh in terms of the order passed by the Commissioner, North Chhotanagpur Division, Hazaribag in Service Appeal No. 27 of 2025. 5. It is made clear that the petitioner should be given an opportunity of hearing before passing any order. It is made that the petitioner will appear before the Deputy Commissioner along with the copy of this order within three weeks from today thereafter the Deputy Commissioner will fix date(s) to hear the petitioner and thereafter pass an appropriate reasoned order, considering the defence of the petitioner. 6. The Deputy Commissioner, Chatra will try to pass a reasoned order within a period of six weeks after the conclusion of the hearing. 7.
