JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused No.1 – husband is before this Court calling in question proceedings in C.C.No.12560/2023, pending before the XXXVII Additional Chief Metropolitan Magistrate, Bengaluru, for offences punishable under Sections 498A and 506 of the IPC. 2. Learned counsel for the petitioner – husband and respondent No.2 – wife in unison submit that the parties to the lis were before the concerned family Court in M.C.No.2852/2025 and have settled their matrimonial dispute - 3 - HC-KAR NC: 2026:KHC:18868 CRL.P No. 13820 of 2023 amicably by drawing up certain terms and conditions and have parted their ways. A photocopy of the memorandum of settlement under Section 89 of the CPC r/w. Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005, a joint memo and separate affidavits of the parties is filed before this Court seeking permission to compound the offences. 3. The joint memo reads as follows: “1. The petitioner herein filed above petition seeking quashing of the charge sheet in CC No. 12560/2023 pending on the file of Hon'ble court of XXXVII ACMM Bangalore for the offence punishable under Section 498(A) & 506 of IPC. 2. The Respondent No.2 herein has no objection for quashing the matter in CC No. 12560/2023 pending on the file of Hon'ble court of XXXVII ACMM Bangalore for the offence punishable under Section 498(A) & 506 of IPC. 3. Both the parties have settled their dispute on the file of MC No.2852/2025 filed by the Petitioner Under Section 13(1)(ia) & 1(b) of the Hindu Marriage Act 1955 as per the settlement the marriage dated 01.09.2021 was dissolved. 4. Both the parties have settled matter on 20.02.2026 by filing the memorandum of settlement Under Section 89 of CPC R/W Rules 24 and 25 of Karnataka Civil Procedure (Mediation) Rules 2005. 5. Both the parties state that they have no claims of their movable or immovable properties either existing or to be acquired in future or ancestral property. - 4 - HC-KAR NC: 2026:KHC:18868 CRL.P No. 13820 of 2023 6. Both the parties further agree that they have no other claim of whatsoever manner against each other past present or future. 7. Both petitioner and Respondent No.2 state and agree that there are no other pending cases and they have withdrawn all the allegations made against each other. 8. Both the petitioner and Respondent No.2 further state that there has been no collusion or force, fraud or any undue influences in entering into this settlement/ agreement in the aforesaid manner. 9. Both the petitioner and Respondent No.2 admit that they shall not interfere in the lives of each other in future.” Though the offence alleged against the petitioner in the case at hand inter alia is one punishable under Section 498A of the IPC, since it is a matrimonial dispute and the parties have arrived at settlement, and the allegations are not against the State, I deem it appropriate to accept the joint memo and affidavits of the parties and terminate the proceedings against the . 4. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petition is disposed. - 5 - HC-KAR NC: 2026:KHC:18868 CRL.P No. 13820 of 2023 (ii) The proceedings in C.C.No.12560/2023, pending before the XXXVII Additional Chief Metropolitan Magistrate, Bengaluru, stand quashed.
