Mr. Manoj Avasthi for complainant HON'BLE MR. JUSTICE GANESH RAM MEENA Order 07/07/2026 1. Petitioner has filed this second bail application under Section 483 B.N.S.S., arising out of F.I.R. No 61/2026, registered with the Police Station Baran Sadar, District Baran for offence under Sections 108 of B.N.S., 2023 and in the order of lower Court for the offences under Section 108, 115(2), 332(c), 352, 146 of B.N.S., 2023. 2. Heard. 3. Considered the submissions made by counsel for the petitioner as well as learned Public Prosecutor and also perused the challan papers. 4. The petitioner has been implicated as an accused alleging abatement to commit suicide. As per the contents of the First Information Report, the petitioner is the person who took the [2026:RJ-JP:25327] (2 of 3) [CRLMB-10193/2026] deceased Ram Swaroop for labour forcefully which hurt him and committed suicide. The police after completion of investigation, has submitted charge-sheet in the matter and the accused- petitioner is said to be in custody since 25.03.2026. 5. Learned counsel for the complainant, who opposed this second bail application, submits that the petitioner has not approached the Court below for release him on bail after filing the charge-sheet, but has filed this second bail application directly before this Court. 6. On Consideration of the submissions made above, it is revealed that the allegation against the accused-petitioner is of taking the deceased along with him forcefully for labour and on being hurt by the said act of the petitioner, the deceased committed suicide. 7. Taking into consideration the overall facts and circumstances of the case and considering the allegations against the accused- petitioner and so also the fact that charge-sheet has already been filed and he is in custody since 25.03.2026, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the petitioner on bail. 8. Accordingly, this second bail application is allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court and any Court to which the matter be transferred, on [2026:RJ-JP:25327] (3 of 3) [CRLMB-10193/2026] all subsequent dates of hearing and as and when called upon to do so.
