WP No.10215 of 2026 For Petitioners : Mr.R.Krishnasamy For Respondents : Mr.K.Raja Standing Counselfor R1 ORDER The writ petition has been filed to issue a writ of mandamus to the respondents to pay the interest for the belated payment of Provident Fund, Gratuity, Earned Leave Salary and Commuted Value of Pension at the rate of 12% per annum to the petitioners herein, within a time frame to be fixed by this Court. 2. The petitioners herein had served in the first respondent- Corporation and had retired on attaining the age of superannuation in the month of May, June and July of the year 2024 . The grievance of the petitioners is that their terminal benefits viz., Provident Fund, Gratuity, Earned Leave Salary and Commuted Value of Pension have been paid to them only on 02.12.2025 and 16.04.2025, as the case may be, after a lapse of more than 1 ½ years and no interest has been paid for the delayed period. Therefore, the petitioners have submitted their individual representations on 08.12.2025, 09.12.2025, 11.12.2025, 11.12.2025, 16.12.2025, 17.12.2025, 16.12.2025 and 10.12.2025 respectively, requesting to pay the interest for the delayed period @ 12% per annum . The learned Standing Counsel for the respondent would fairly submit that the respondents are willing to pay the interest at the rate of 6% per annum for the belated payment for the eligible and admissible amount. 4. Heard the learned counsel for both sides and perused the materials available on record. 5. In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioner, within a period of six weeks from the date of receipt of a copy of this order. 6.
