Kunwar, learned Additional C.S.C. for the State of Uttarakhand. 4. Since common questions of law and fact are involved in these petitions, therefore, they are being heard and decided together. However, for the sake of brevity and convenience, facts of WPMS No. 2256 of 2026 alone are being considered and discussed. 5. By means of this writ petition, petitioner has sought the following reliefs:- (i) To Issue an appropriate writ, order, or direction and quash the arbitrary affiliation process fee demands made by Respondent University via letter no 207/VMSBUTU/2023 dated 18/04/2023 issued by the Registrar, Respondent no 1 University (Annexure no 2, Page no. 20 to 22) and further declaring that Respondent University has no authority to levy fees beyond the mandate of the Act and Government Orders. (ii) To issue an appropriate writ order or direction in the nature of mandamus directing the Respondent University to strictly adhere to the Government Order dated 14.12.2016 and continue with the affiliation process schedule of Letter no 856/VMSBUTU/2026-27 dated 16-06-2026 as per the fee prescribes for Affiliation process in Government Order dated 14.12.2016. (iii) To Direct refund or adjustment of excess amounts UKHC010130762026 2026:UHC:7331 already collected from the Petitioner institution. 6. Petitioner is running a Law College. According to him, Uttarakhand Technical University is not granting affiliation to the college. Uttarakhand Technical University is asking for affiliation fee of ₹1.00 lakh plus GST for each course, which is contrary to Government Order. 7. Learned counsel for the petitioner submits that Bar Council of India will grant recognition to the petitioner once it is affiliated by Uttarakhand Technical University. 8. Learned counsel for Uttarakhand Technical University submits that affiliation fee is being charged as per decision taken by Executive Council in its meeting held on 27.03.2023. 9. Learned counsel for the petitioner submits that without amending the statute, University cannot ask for affiliation fee. He, however, submits that the writ petition be disposed of by permitting petitioner to make representation to the Competent Authority. 10. Be that as it may, since learned counsel for the petitioner has confined the relief and has prayed for direction to Registrar of Uttarakhand Technical University to decide representation to be made by petitioner. 11. The writ petitions are, accordingly, disposed of with liberty to petitioners to make representation(s) within two weeks from today. If petitioner(s) makes representation(s) within stipulated time, decision thereupon shall be taken by the Registry, Uttarakhand Technical University, as per law, within eight weeks thereafter.
