Petitioner is plaintiff in Original Suit No. 4 of 2024. Learned trial court vide order dated 04.04.2026 held that the court fee furnished by petitioner with the plaint of the suit is insufficient. Thus, feeling aggrieved, petitioner has approached this Court by filing writ petition. 4. Learned counsel for the respondent submits that petitioner has statutory remedy of appeal under Section 6A of Courts Fee Act, 1870, therefore, writ petition is not maintainable. 5. Learned counsel for the petitioner, however, contended that Section 6A was added in the Courts Fee Act by an amendment made by UP Act No. 19 of 1938. She submits that the said amendment is applicable only in State of Uttar Pradesh and is not applicable in Uttarakhand. UKHC010080912026 2026:UHC:7173 6. Learned counsel for the respondents, however, submits that in view of express provision contained in Sections 86 and 87 of UP Re-organisation Act, 2000, upon State reorganisation, all State Legislations, which were applicable in erstwhile State of U.P., became applicable in successor State of Uttarakhand. 7. This Court finds substance in the said contention. 8. The writ petition is, accordingly, disposed of with liberty to petitioner to approach the appropriate forum under Section 6A of the Courts Fee Act. Petitioner shall be at liberty to claim benefit of Section 14 of Limitation Act before the appropriate forum.
