1. Heard learned counsel for the petitioners and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Aul P.S. Case No.305 of 2025 corresponding to G.R. Case No.774 of 2025 pending in the court of learned J.M.F.C., Aul on the grounds stated.
3. The petitioners are having antecedents. The Court further finds that the accused persons had earlier approach this Court in ABLAPL No.12487 of 2025. Learned counsel for the petitioners would submit that the petitioners do not have more than two antecedents. Recorded the objection of the State. Since the petitioners had earlier approached, this Court reiterates the view already expressed before and directs them to surrender before the court of learned J.M.F.C., Aul and move
regular bail for being considered during the 1st hour and in the event of rejection, to approach the Sessions Court.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender within a fortnight from today before learned J.M.F.C., Aul in connection with Aul P.S. Case No.305 of 2025 corresponding to G.R. Case No.774 of 2025 and move regular bail, it shall be duly considered in view of the direction as aforesaid. The learned court below, as is further directed, shall consider plea for bail of the petitioners in view of the claim that each of them is having not more than two antecedents.
6. Issue urgent certified copy of this order as per rules.
