Heard both the sides. This bail application has been filed on behalf of Rohit Yadav who is in custody since 08.09.2024 in connection with Giridih(M) P.S. Case No. 284 of 2024 corresponding to G.R. Case No. 23 of 2025 and S.T. Case No. 80 of 2025 for the offence registered under Sections 126(2), 115(2), 118, 125, 74, 303(2), 109, 3(5) of BNS, 2023 pending in the Court of Addl. Sessions Judge-V, Giridih is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that initially the case was registered under Section 109 and other sections of BNS and later on, the deceased remained hospitalized for 7-8 days and consequently, the case was registered under Section 103 of BNS, 2023 after his death. It is further submitted that general and omnibus allegation leveled against all the three accused persons. The incidence took place at the spur of moment over a trivial dispute and so the offence under Section 103 of BNS will not be made out and it will come under Section 102 of BNS. Learned A.P.P. for the State assisted by the counsel on behalf of the informant have vehemently opposed the prayer for bail and submitted that the informant is the eye witness and there is direct and specific allegation of assault resulting in death of Shibu Mahto. 2026:JHHC:1636 Considering the facts and circumstances of the case, the prayer for bail of the petitioner, is hereby, rejected.
