03 /17.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 309(5) of the Bharatiya Nyaya Sanhita and Sections 27 of the Arms Act.
2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order.

Learned counsel for the petitioner submits that the First Information Report (FIR) has been lodged after 4 days’ delay and nothing has been recovered from the possession of the petitioner.
4. Learned APP opposes the prayer for bail and submits that this is a case of robbery.
5. After hearing the learned counsel for the parties and after going through the record, I find that the petitioner is named in the FIR and there are 3 other criminal cases pending against the petitioner and out of them, two are of robbery being Hansdiha PS Case No. 79 of 2023 and Mohanpur PS Case No. 229 of 2023 under Section 395 of IPC. There is also a murder case against the petitioner being Saraiyahat PS Case No. 46 of 2024 under Section 302/34 of IPC.

6. Considering the aforesaid fact, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Saraiyahat PS Case No. 90 of 2025, pending in the Court of learned Judicial Magistrate, 1st Class, Dumka stands rejected.
7. Accordingly, this bail application is dismissed.
