The instant petition has been moved by the applicants –Shri Manjeet Singh and Smt. Gurmeet Kaur, who are the in-laws of respondent no.2, under Section 528 of BNSS, 2023 for quashing of the entire proceedings of the Criminal Case No.2453 of 2025, “State of Uttarakhand Vs. Gurvinder Singh and others” pending in the court of Additional Chief Judicial Magistrate/First Additional Civil Judge (S.D.) Rudrapur, District Udham Singh Nagar arising out of FIR dated 31.12.2024 bearing FIR No.0362 of 2024, Police Station Transit Camp, District Udham Singh Nagar, wherein, the present applicant has been summoned to face the trial for the offences punishable under Sections 85, 115 (2), 351 (2), 352 and 333 of BNS, 2023 and under Sections ¾ of the Dowry Prohibition Act, 1961. 5. The petition is filed along with compounding application (IA No.1/2026) with the affidavit of the applicants and the respondent no.2. Applicants and respondent no.2 are present in Court and are duly identified by their respective counsels. It is submitted by the applicants that they have resolved their dispute amicably with the respondent no.2 as their son and respondent no.2, now decided to live together and there is no any dispute against each other. 6. Learned AGA submits that since now the parties have settled their dispute amicably, therefore, proceeding should not be permitted to continue in such a situation, and the continuation of the proceedings is completely a futile exercise. 7. After hearing the submissions of the learned counsel for the parties and taking into consideration that since the parties have settled their dispute amicably, there is no useful purpose to continue the proceedings. 8. In such view of the matter, the instant C528 application as well as the compounding application are allowed, and the entire proceeding of Criminal Case No.2453 of 2025, “State of Uttarakhand Vs. Gurvinder Singh and others” pending in the court of Additional Chief Judicial Magistrate/First Additional Civil Judge (S.D.) Rudrapur, District Udham Singh Nagar, is hereby quashed.
