Order No.
ORDER 19.03.2026
01. 1. Both the ABLAPLs are disposed of by the following common order. 2. Heard Mr. Jena, learned counsels for the petitioners and Mr. Lenka, learned ASC for the State. Page 2 of 3
3. Instant petitions under Section 482 BNSS are filed for pre-arrest bail of the petitioners in connection with Tangi P.S. Case No.31 of 2026 corresponding to G.R. Case No.117 of 2026 pending in the file of learned J.M.F.C.-II, Cuttack on the grounds stated therein. 4. The case diary is received by the State. Learned counsel for the State submits that for the incident, the petitioners created a law and order situation and manhandled the informant and hence, the report. In response to the above, learned counsel for the petitioners submits that the informant reached at the spot and demolished structures without notice and demarcation, hence, it was protested. The further claim is that the land over which the construction was raised and demolished by the informant stands in the name of the mother of the petitioners in ABLAPL No.1818 of 2026. In support of such claim, a copy of the RoR in the name of the mother of the above accused persons is produced. The photographs at the time of action taken by the informant for demolition have also been produced by the learned counsel for the petitioners and the same are perused. Considering the fact that the petitioners, who claimed to have resisted the demolition taken up by the informant and allegedly committed the excess and attempted to prevent such demolition as claimed in the FIR but in absence of any past antecedents against them, this Court is of the view that they should instead be directed to surrender before the learned court below for being released on bail with stringent conditions.
