Ms. Sheetal Selwal, Advocate for the petitioner. 2. Mr. Rajendra Arya, Advocate, holding brief of Mr. Neeraj Garg, Advocate for respondent no. 3. 3. Petitioner was engaged through UPNL as Data Entry Operator in District Legal Services Authority, Almora w.e.f. 16.11.2021. His engagement is discontinued, as the post against which petitioner was appointed, is filled by regular appointment. 4. By means of this writ petition, petitioner has sought the following reliefs:- ‘i) Issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 04-06-2026 passed by respondent no. 2 (contained as Annexure no. 2, page no. 22 to this writ petition). ii) to Issue a writ order or direction in the nature of mandamus commanding and directing the respondents reinstate/reengage the petitioner in services on the post of Data Entry Operator in the respondent no. 2 Department and UKHC010145532026 2026:UHC:7372 pay him all emoluments as and when it became due.” 5. By the order dated 04.06.2026, petitioner’s engagement is discontinued on the ground that the vacancy in question is no more available. The reason assigned for discontinuing petitioner’s engagement cannot be faulted. Two persons cannot be permitted to continue against one post. 6. Learned counsel for the petitioner submits that petitioner has made representation to the Chairman, District Legal Services Authority regarding his reengagement on some other post, therefore, Chairman be directed to take decision in the representation. 7. Having regard to the facts of the case, the writ petition is disposed of with direction to Chairman, District Legal Services, Authority to consider petitioners representation dated 12.06.2026 (Annexure-6 to the writ petition), as per law, within six weeks from the date of presentation of certified copy of this order.
