The instant writ petition is preferred against the impugned order dated 14.09.2022 (Annexure P/1), whereby respondent No. 2 has dismissed the appeal filed by the petitioner, affirming the order dated 26.08.2022 (Annexure P/2) passed by respondent No. 3 YOGESH TIWARI Digitally signed by YOGESH TIWARI Date: 2026.05.05 18:45:46 +0530
2 directing removal of the petitioner’s house constructed over land bearing Khasra No. 898. By filing the present petition, the petitioner calls in question the legality, validity and propriety of the aforesaid orders on the ground that the same are arbitrary, without authority of law and passed in violation of principles of natural justice. The petitioner has prayed for following reliefs :-
“10.1 That, this Hon'ble Court may kindly be pleased to call the records pertaining to the case from the respondent authorities. 10.2 That, this Hon'ble Court may kindly be pleased to quash the impugned order dated 14.09.2022 (Annexure P/1) and further be pleased to direct the respondent authorities to allot/settle the land bearing khasra no. 898 in favour of petitioner as per policy of State Government dated 11.09.2019. 10.3 To kindly grant any other relief which may be deem fit in the given facts and circumstances of the instant case.”

Learned counsel for the petitioner, after arguing the matter for some time, seeks permission of this Court to withdraw the present petition with liberty to approach the competent authority by way of an appropriate application for redressal of the grievance.
3. Learned State counsel has no objection to the aforesaid course being adopted.
4. Considering the aforesaid submission, the prayer is allowed. The present writ petition is dismissed as withdrawn with liberty as
3 prayed. It is directed that the petitioner shall file a comprehensive representation/application before the competent authority within a period of 20 days from the date of receipt of a certified copy of this
order, raising all grounds and annexing all relevant documents in support of his claim.

Upon such application being filed, the competent authority shall consider and decide the same strictly in accordance with law, after affording an opportunity of hearing to the petitioner and conducting such enquiry, including demarcation if required, within a further period of 60 days thereafter.
6. It is further directed that till the petitioner’s application is decided by the competent authority, no coercive steps shall be taken against the petitioner in respect of the subject property.
7. With the aforesaid observations and directions, the writ petition stands disposed of. No order as to costs. Sd/-
