This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 552/2024 registered at Police Station – Khamhardih, District – Raipur (C.G.) for the offence punishable under Sections 454, 380 and 120B of the IPC.

Case of the prosecution, in brief, is that complainant has submitted a written complaint against the accused in the police station that on 28.12.2022, on the instructions of the gang leader of coal smuggling crime Nikhil Chandrakar, two persons named Golu alias Ganesh Verma and Nilesh Sarvaiya, Thieves broke into her house with a duplicate key, committed housebreaking, and stole her vital medical documents, mark sheets, educational documents, and other items RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 with the intent to destroy evidence under Sections 376 and 377 of the Indian Penal Code. The incident was recorded on CCTV, in which Ganesh Verma @ Golu is seen entering the house and stealing, while Nilesh stands out of the camera's reach, observing. Based on the complainant's report, a case was registered against the accused under Sections 454, 380, and 120B of the Indian Penal Code, and they were taken into custody and after investigation, a charge sheet has been filed against the accused. Hence, this application.

Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is submitted that the co-accused have been granted bail by this Court vide order dated 01.08.2025 and 18.07.2025 passed in MCRC Nos. 6030/2025 and 5661/2025, and have undergone a short period of detention. So far as the applicant is concerned, no doubt he has been arrested on 20.03.2026, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel, opposes the bail application and submits that though the co-accused have been granted bail by this Court vide order dated 01.08.2025 and 18.07.2025 passed in MCRC Nos. 6030/2025 and 5661/2025, but the present case is of the year 2024 it is stated that the applicant was absconding in the present case and arrested by the Police on 20.03.2026 and the trial is under progress and the charge-sheet has already been filed against him as an absconder, and there is every
3 likelihood that if he shall be allowed bail by this Court, he will abscond again. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and also the fact that though the co-accused have been granted bail by this Court vide order dated 01.08.2025 and 18.07.2025 passed in MCRC Nos. 6030/2025 and 5661/2025, but the present case is of the year 2024 it is stated that the applicant was absconding in the present case and arrested by the Police on 20.03.2026 and the trial is under progress and the charge-sheet has already been filed against him as an absconder, and there is every likelihood that if he shall be allowed bail by this Court, he will abscond again, and the case of the applicant is distinguishable from that of the co-accused, thus, looking to the conduct of the applicant as he was absconding, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7.

Accordingly, this bail application of applicant – Ganesh Verma involved in Crime No. 552/2024 registered at Police Station – Khamhardih, District – Raipur (C.G.) for the offence punishable under Sections 454, 380 and 120B of the IPC, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed with the trial and conclude the same, expeditiously. 4
