Mr. Laxmi Narayan Patel, learned counsel for the Petitioners by filing a memo prays to not press the bail application of the Petitioner No.2 Anil Kumabhar and accordingly, the bail application of the Petitioner No. 2 Anil Kumabhar stands disposed of as not pressed and the present bail application is only confined to the Petitioner No. 1 namely Niranjan Bag. 2. This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Sohela PS Case No.367 of 2025 corresponding to GR Case No.586 of 2025 pending in the Court of learned JMFC, Sohela for commission of offences punishable U/Ss. 276/277/111(2)(b)/3(5) of BNS, on the main allegation of possessing 26 bottles of 100ml. Eskuf Syrup containing codeine phosphate and 10 liters of adulterated cough syrup in a plastic jar. 3. Heard, Mr. Laxmi Narayan Patel, learned counsel for the petitioner and Mr. R.B. Mishra, learned Addl. PP in the matter and perused the record. 4. After having considered the rival submissions and taking into consideration the nature and gravity of the offence as alleged against the petitioner vis-a-vis the accusations sought to be brought against him and regard being had to the pre-trial detention of the petitioner in custody since 01.12.2025 with submission of charge sheet in the meantime as submitted by learned counsel for the Petitioner and keeping in view the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial and there being no criminal antecedent reported against the Petitioner, this Court without expressing any view on merits admits the Petitioner to bail. 5. Hence, the bail application of the petitioner- Niranjan Bag stands allowed and he is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 6.
