In the instant application, the applicants herein seek a direction upon Registrar Judicial, High Court Wing, Jammu to transfer the arbitral amount deposited before him in terms of the order of this Court to the competent authority under National Highway Act 1988, being Dy. Commissioner, Reasi for its disbursement in favour of land holders. 2. It is stated in the application in hand that appeals being AA No.4/2025 and AA of 05/2025, filed under Section 37 of the Arbitration and Conciliation Act 1996 came to be filed by the National Highway of Authority of India against the order passed by the District Judge, Reasi in Arbitration application filed under Section 34 of the Act of 1996, filed against the arbitral award dated 26.08.2023, passed by the sole Arbitrator under the National Highway Act 1988 and that this Court while entertaining the said appeals passed an order on 25.04.2025, staying the execution of the award subject to depositing of the award amount before the Registrar Judicial of Jammu Wing of this Court within a period of six weeks, whereupon the National Highway Authority of India deposited the award amount before the Registrar Judicial. 3. It is also stated that the said appeals came be dismissed by this Court in terms of judgment and order dated 12th February, 2026, as such, entitling the land holders contesting the said appeals to the said award deposited before this Court by the National Highway Authority of India, thereby necessitating the passing of an appropriate direction in this regard including the one sought in the instant application. Heard and considered. 4. At the very outset Mr. Pawan Kumar Hanas, appearing counsel for the National Highway Authority of India expresses no objection to the prayer made in the application by the applicants. 5. Having regard to the record available on the file inasmuch as, the prayer made in the instant application, as well as no objection expressed by the counsel for the National Highway Authority of India, the instant application is allowed and the Registrar Judicial, Jammu Wing of this Court is directed to transfer the award amount deposited by the National Highway Authority of India to the Competent Authority, under National Highway Act, 1988 for its disbursement along with interest, if any, accrued thereon in favour of the land holder/claimants/interested person.
