2. Heard Mrs. Mohua Palit, learned counsel appearing on behalf of the opposite party- State of Jharkhand.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.07.2025 in connection with Kadma P.S. Case No. 65 of 2025, registered under Sections 137(2)/96 of the B.N.S., now pending in the court of learned Sub-Divisional Judicial Magistrate, Jamshedpur.

Learned counsel for the petitioner submits that as per the F.I.R. the daughter of the informant aged 16 years was taken away by the petitioner. Learned counsel submits that during investigation it has come that after travelling by bus and also train, the daughter had gone to Patna and upon investigation the victim was recovered from the house of the petitioner. 5. He further submits that the Medical Board has assessed the age of the victim, 17 years plus/minus 1 and the petitioner came in contact with the victim through Instagram. Learned counsel has submitted that it is a clear case of love affair between the petitioner and the victim and so far as that the stage of the case is concerned, the victim as well as the informant have already been examined before the court. 6. Learned A.P.P. has opposed the prayer for bail of the petitioner. However, the aforesaid aspect of the matter as placed by the learned counsel for the petitioner has not been disputed except that as per the

FIR the victim was 16 years of age. However, she could not point out any document from the School / Education Institution to show the exact age of the victim. 7. Considering the aforesaid facts and circumstances and the fact that the victim and the petitioner are of adolescent age as per the Medical Board age of victim is 17 plus minus 1 years and the petitioner is 20 years old, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jamshedpur, in connection with Kadma P.S. Case No. 65 of 2025, on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court.
(v) The petitioner shall fully co-operate with the proceedings before the learned trial court. (vi) The petitioner shall not disturb the victim and her family in any manner. 8. The instant application is allowed with the aforesaid conditions. 9. Let a copy of this order be communicated to the learned court concerned through “FAX/email”. (Anubha Rawat Choudhary, J.)
