ORDER:
The writ petition is filed to declare the inaction of the respondents Nos. 2 to 5 in stopping illegal construction of B.C. community hall in an extent of Ac. 1.56 cents in R.S. No. 496, situated in Rangampeta Village, Kakinada District by local political leaders despite the letter dated 12.06.2026 of the respondent No. 3 to the respondent No. 4; P.G.R.S. reply acknowledgment dated 19.06.2026 issued by the respondent No. 3; legal notice dated 18.07.2026 issued by the petitioner to the respondents Nos. 2 to 5 as illegal & unlawful and direct the respondent No. 2 to consider the P.G.R.S representation dated 18.05.2026 of the petitioner and several others belonging to S.C. community to allot the subject land for construction of S.C. community hall for the welfare of S.C. community. 2. The learned Assistant Government Pleader for Panchayat Raj and Rural Development placed on record a copy of written instructions of the respondent No. 5 vide Rc. No. A1 / Court Cases / 2026, dated 19.08.2026, wherein it is stated as follows:
“The work relating to „Construction of Multipurpose Activity Centre Building in B.C. area of Rangampeta (V) & (M)‟ was sanctioned under M.P.L.A.D.S. grant. As on date, the said building work has not been commenced. The work will be taken up only after obtaining the necessary permissions / clearances from the Zilla Praja Parishad, Kakinada. There is no deliberate inaction on the part of the Panchayat Raj Engineering Department in respect of the said work.
The Department is taking necessary steps for obtaining the required permissions and the work will be commenced in accordance with the applicable rules and procedures upon receipt of the necessary permissions from Zilla Praja Parishad, Kakinada, previously in the

survey No. 496 B.C. hostel was dismantled as the building was in dilapidated condition and same land was allocated for the construction of multipurpose activity centre building in B.C. area of Rangampeta V&M.”
3. The learned Assistant Government Pleader for Panchayat Raj and Rural Development placed on record a copy of written instructions of the respondent No. 3, dated 25.08.2026, wherein it is stated as follows:
“The petitioner in this W.P. has submitted the petition through P.G.R.S. on 18.05.2026 and requested to allot the land an extent of Ac.1.56 cents in survey No. 496 situated in Rangampeta Village of East Godavari District, and the same has been sent to this office on 18.05.2026. An urgent office note has been issued to the Revenue Officer, Zilla Praja Parishad, Kakinada on 20.05.2026 with direction to conduct field level enquiry and submit report. The Revenue Officer, Zilla Praja Parishad, Kakinada has submitted report on 12.06.2026 and stating that the said land details are not available in Zilla Praja Parishad, Kakinada also suggested that address the Tahsildar, Rangampeta to conduct survey with the Mandal Surveyor and also informed that if any land relating to Zilla Praja Parishad Management to alienate to other department, proposals have to submit to the government duly approval of the zilla praja parishad general body. After getting approval from the government, the land may be alienate to other department, and the matter has been informed to the Petitioner. On 06.06.2026, the petitioner has requested the information through R.T.I. Act, 2005, and informed that the foundation stone has been laid on 09.05.2026 for construction of B.C. community hall in the above said site, is any approval has been issued by Zilla Praja Parishad

or not, and are the land allocation is being made for S.C.,S.T. community hall or not.
On 12.06.2026 a letter had been issued to Superintendent Engineer, Panchayat Raj, E.G.Dt., Rajamahendravaram with warn to the said above land belongs to Zilla Praja Parishad, Kakinada and not to take up any constructions without obtaining prior approval from the Zilla Praja Parishad, and will be held responsible for any severe consequences as the petitions has been received for allotment of land for construction of S.C. community hall. On 23.06.2026, the Executive Engineer, Panchayat Raj, E.G.Dist., Rajamahendravaram has addressed to the Chief Executive Officer, Zilla Praja Parishad, Kakinada and stating that laid foundation stone by the Hon'ble M.P., and M.L.A., Anaparthi in the above site and requested to grant necessary permission to construct the B.C. community hall. On 07.08.2026, a letter has been addressed to the Executive Engineer, Panchayat Raj Division, E.G.Dt., Rajamahendravaram and informed that instructions had already been issued that no permission has issued to any constructions in that site and directed to stop all the constructions works immediately in S. No. 496 situated in Rangampeta Village and submit action taken report within 24 hours and also informed that will be held solely responsible for any consequences arising from any negligence in this matter. On 11.8.2026, the Revenue Officer, Zilla Praja Parishad, Kakinada has submitted his report to this office and stating that the construction work which is being taken up subject land has been stopped by the Engineering Department. As per G.O.Ms. No. 215, Panchayat Raj and Rural Develoment (Pts.III) Department, dated: 25.06.2001, in case of alienation to a

government department, of the land and structure belonging to Gram Panchayat; where the value is more than Rs.25,000/- and in the case of Mandal Parishad, where the value is more than Rs.50,000/- prior approval of Collector shall be obtained and in case of Zilla Parishads, where the value exceeds Rs.2.00 lakhs, prior approval of the government shall be obtained.
In case of alienation in favour of government organizations where the government has a stake of more than 50% and whenever the value of the land exceeds Rs.25,000/- in the case of Gram Panchayat, Rs.50,000/- in the case of Mandal Parishad, and Rs.1.00 lakh in the case of Zilla Parishad, prior approval of government shall be obtained. (necessary corrections are made to bring the statement in accordance with the G.O.)
As per the Presidential Order, 2025, the present and erstwhile East Godavari District, Kakinada are going to be bifurcated into 04 Zilla Praja Parishads, i.e., 1. Kakinada 2. Dr.B.R. Ambedkar Konaseema 3. East Godavari and 4. Polavaram, and the Assets will be distributed among 04 Zilla Praja Parishads, and the assets (vacant lands) are very essential to develop the newly formed Zilla Praja Parishads.”
4. The written instructions further enclosed with the correspondence letter from Deputy Executive Engineer, P.R.I. Sub-division, Biccavolu vide Rc. No. SA / Detailed Report / 2026, dated 04.08.2026 and letter from the respondent No. 5 vide Rc. No. / Reports / 2026, dated 17.06.2026 was addressed to the respondent No. 3. 5. In view of the written instructions specifically stating that the building work has not commenced in both the written instructions of the respondents Nos. 3 and 5, the learned counsel for the petitioner requested to dispose of the writ petition recording the instructions as part of the order, granting liberty to the writ petitioner to approach this Court in case of further deviations. 6 BSB,J W.P.No.22976 of 2026
6. Accordingly, recording the written instructions as part of this order, the writ petition is disposed of granting aforesaid liberty to the petitioner. There shall be no order as to costs.
