Present applicant-Sethpal, S/o Kaliram Saini is praying for bail in reference to first information report dated 10.08.2025 bearing FIR No.0818 of 2025, P.S. Laksar, District Haridwar wherein the present applicant alongwith five others, namely, Parvinder Saini, Ravi Kashyap, Sanjay Saini and Pushpendra Kumar were implicated for the offences punishable under Section 318(3), 336(3), 338, 340(2), 61(2) of BNS, 2023. 4. It is submitted by learned counsel for the applicant that present applicant is innocent and has been falsely implicated and infact the allegation as alleged itself reveals that the dispute was primarily of the civil nature since the informant herself executed two sale deeds in favour of the applicant and there is no dispute on this but there is allegation with regard to the another sale deed that it was executed by impersonating the informant. He submits that main allegation is against the person, who was already in jail on the date when the alleged sale deed was executed. He submits that charge sheet has already been filed and the present applicant is languishing in jail since 24.08.2025 and there is no substantial progress in the trial and furthermore the applicant has no criminal antecedents though the prosecution in their counter affidavit referring only one case but in that case the present applicant is not involved. He also submits that other co-accused namely, Gyaneshwar Thakral, Parvinder Saini and Ravi Kashyap have been enlarged on interim bail by the Coordinate Bench in an Anticipatory Bail Application and subsequently co-accused Parvinder Saini, was also exonerated. 5. On the other side, Mr. Sandeep Sharma, learned AGA have not disputed that the charge sheet has already been filed and the present applicant is languishing in jail since 24.08.2025. He has also not disputed that the three other co-accused persons have been granted interim bail by the Coordinate Bench. 6. After hearing the submissions of learned counsel for the parties and taking into consideration that the charge sheet has already been filed and the applicant is languishing in jail since 24.08.2025 and he has no criminal antecedents, this Court is of the view that applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the present applicant-Sethpal Kumar be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
