It has been averred in the application that the copy of impugned judgment and decree dated 07.03.2025 was applied by the counsel on 01.04.2025 and the same was prepared and delivered on 24.04.2025. Thereafter the legal opinion was sought so as to challenge the impugned judgment before this Court and after receiving the same the matter was examined at various levels for the purpose of filing of arbitration appeal. In the said process some delay has occurred, which is neither intentional nor willful, but the same has occurred due to unavoidable circumstances, which were beyond the control of the applicant/appellant. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit and in view of the submissions made by learned counsel for the applicant/appellant, the present application is allowed and delay in filing the appeal is condoned.
