By way of the present writ petition filed under Article 226 of the Constitution of India, the petitioners have approached this Court 4 seeking a direction to the respondent authorities, particularly respondent No. 2, to consider and decide their pending representation/application dated 10.07.2025, whereby the petitioners have claimed compensation in respect of land acquired by the State authorities. 2. The case of the petitioners, in brief, is that the land bearing Khasra No. 466 admeasuring 0.559 hectare situated at Village Ranwabhatha, Tahsil Dharsiwa, District Raipur, originally belonged to their ancestor Late Niman S/o Mohan Satnami, and thereafter stood recorded in the name of Siyaram S/o Niman. It is submitted that the said land was acquired by the respondent authorities and an award dated 05.11.1994 came to be passed; however, the compensation amount was wrongly disbursed in favour of one Siyaram S/o Samaru (Caste Teli), who, according to the petitioners, is not entitled to the same. It is further submitted that upon gaining knowledge of the said fact, the petitioners submitted a detailed representation dated 10.07.2025 before respondent No. 2—Collector, Raipur, seeking compensation as well as appropriate inquiry into the matter. However, the said representation is still pending consideration. 3. Following reliefs have been prayed by way of this petition:- “10.1 That, this Hon'ble Court, may kindly call for the entire record in relates to the case of the Petitioners. 5 10.2 That, this Hon'ble Court, may kindly be pleased to direct the Respondent No. 02 to decide the pending representation / application dated 10.07.2025 (Ann P-1) filed by the Petitioners, within stipulated period, in the interest of justice. 10.3 That, any other relief, this Hon'ble Court, deem fit and proper may also kindly be granted to the Petitioners, in the interest of justice.” 4. Learned counsel for the petitioners submits that the land in question belonged to the petitioners’ ancestors and has been acquired by the State; however, compensation has been wrongly paid to another person. It is further submitted that despite filing a detailed representation dated 10.07.2025, the respondent authorities have not taken any decision till date, which amounts to arbitrary inaction. Learned counsel submits that even though the award has been passed in the name of some other person, the petitioners, being rightful claimants, are entitled to receive compensation, and therefore, a direction may be issued to the competent authority to consider and decide the said representation within a stipulated period. 5. Learned State counsel submits that the competent authority shall consider the grievance of the petitioners in accordance with law. It is further submitted that if the representation is pending, the same can be decided within a reasonable time frame. 6 6. Having heard learned counsel for the parties and perused the record, this Court finds that the grievance of the petitioners is limited to non-consideration of their representation dated 10.07.2025 submitted before respondent No. 2. It is not in dispute that the said representation is pending before the competent authority. Once a representation raising a claim for compensation has been submitted, the same is required to be considered and decided within a reasonable period. 7. Without entering into the merits of the rival claims, particularly with regard to entitlement of compensation, this Court is of the considered opinion that the ends of justice would be served if a direction is issued to the competent authority to consider and decide the pending representation. 8. Accordingly, the present petition is disposed of with a direction to respondent No. 2—Collector, Raipur, to consider and decide the representation/application dated 10.07.2025 submitted by the petitioners, strictly in accordance with law, after affording an opportunity of hearing to all concerned parties as exepititously as possible. 9. It is further observed that while deciding the representation, the competent authority shall also consider the claim of the petitioners with regard to their entitlement to compensation, notwithstanding the fact that the award has been passed in the name of some other person. 7 10.
