For the respondents: Mr. Pushpinder Jaswal, Additional Advocate General. Ajay Mohan Goel, Judge (Oral) Learned Additional Advocate General has handed over instructions which are taken on record. He submits that in the present case the petitioner was transferred against a vacancy which was to fall vacant on the retirement of the incumbent serving there on 30.04.2026, however, before the petitioner could be released, the Model Code of Conduct was imposed by the State Election Commission on 28.04.2026 on account of the Election of local bodies. He thus, submits that the petition be disposed of with the direction that the petitioner shall be relieved to join his place of transfer after the Model Code of Conduct is lifted. Ordered accordingly. 2. This Court is of the considered view that as now the vacancy against which the petitioner was transferred is lying vacant that too, in a School, it would be in the interest of justice in case the 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:16278 petitioner is allowed to be relieved from his present place of posting so that he can join at the station to which he stands transferred so that the study of the students is not hampered. 3. Accordingly, this petition is disposed of with the direction that the Authority concerned shall relieve the petitioner on the strength of the order being passed by this Court in the present petition and the petitioner shall be entitled to join the station to which he stands transferred. The Model Code of Conduct shall not come in the way of the respondents in implementing the transfer order of the petitioner.
