DATE : 22 .09.2026 In the present petition, following are the prayers made by the petitioner: “(i) Allow the instance petition, and direct the respondent no.3 to modify the order dated 27.01.2026 (Annex D) passed in CLR no.112025/73/102/Adhi Ja no.572. (ii) Direct the respondent no.3 to decide the application filed by the petitioner on dated 18.11.2025 (Annex E). (iii) ....” 2. Admittedly, as far as prayer clause (i) is concerned, the petitioner had not approached respondent No.3 - the Collector seeking modification of the order dated 27/01/2026, before filing the present petition. Furthermore, it is evident from prayer clause (ii) that the application of the petitioner dated 18/11/2025 is pending for decision before the Collector. 2026:BHC-NAG:12545-DB 924.wp.1430.26 2/2 3. In the above circumstances, upon instructions, learned Counsel for the petitioner seeks withdrawal of the present petition with liberty to approach the Collector to seek modification of the order dated 27/01/2026 and to request the Collector to decide the application dated 18/11/2025. 4. Accordingly, the petition is disposed of as withdrawn, with liberty as prayed for. 5. It is directed that if such application for modification is made along with the prayer to decide the application dated 18/11/2025, the Collector shall take a decision on the same expeditiously.
