(Oral) Applicant is in judicial custody in FIR No.256 of 2020, under Section 302 IPC, Police Station Transit Camp, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. This is the second bail application. The first bail application, being BA1 No. 1354 of 2024, was rejected on 07.11.2024. 4. It is argued by learned counsel for the applicant that the applicant is in custody for more than five years now; there are 30 witnesses, out of which only 10 witnesses have yet been examined, and the trial would take a long time to conclude. 5. This fact is not disputed by learned State Counsel. 2 6. Having considered the period of incarceration and other attending factors, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
