1. Mr. Shiv Chandra Prasad, learned counsel for the petitioners and Mr. S. K. Datta,
learned counsel for the respondent no.1, are present. With the consent, the matter is finally heard.
2. During the course of hearing, learned counsel for the parties fairly submitted that the impugned order dated 23.05.2023 passed in M.A. 468 of 2023 [In O.A.1997 of 2022 (Kolkata)] in an interlocutory order and original application is still pending.
3. It is agreed that the impugned order dated 23.05.2023 is passed in M.A. 468 of 2023 during a situation where reply of the said M.A. was awaited. Mr. Prasad, learned
2 counsel for the department informed that reply in the said O.A. has already been filed.
4. Parties agreed that this petition may be
disposed of by directing the Tribunal either to decide the aforesaid O.A. on merits or decide M.A. 468 of 2023 by considering the reply filed in the O.A. of present petitioner.
5. In view of consensus arrived at, this petition is disposed of by directing the Tribunal to decide the O.A. 1997/2022 (Kolkata) itself on merits expeditiously preferably within 60 days from the date of production of copy of this order. However, if there is any difficulty in deciding the said O.A. on merits, the Tribunal shall endeavour to decide M.A. 468/2023 by considering the reply in O.A. of the petitioners expeditiously preferably within 15 days from the date of production of the copy of this order.

6. With the aforesaid and without expressing any opinion on merits, WPCT 43 of 2026 is
disposed of.
