JUSTICE M.I.ARUN ORAL ORDER The impugned order has been passed against the petitioners on the ground that the petitioners have violated the sanctioned plan and have constructed the building. On perusal of the records, I do not find any irregularity in the same. 2. After arguing the matter for some time, the learned counsel appearing for the petitioners submits that presently amendments have been introduced to the - 4 - HC-KAR NC: 2026:KHC:14510 WP No. 6536 of 2026 Regulations regarding the setback that needs to be left while putting up a construction on a vacant site and also for changing a B-Khata property into a A-Khata. It is submitted that the petitioners intend to make use of the said changes in law by making a fresh representation to the authorities concerned; and they seeks permission of this Court to make such a representation. 3. Learned counsel for the respondents - Bruhat Bengaluru Mahanagara Palike, now the Greater Bengaluru Authority, fairly submits that if such an application is made by the petitioners, the same shall be considered in accordance with law and appropriate orders will be passed. 4. For the aforementioned reasons, the Writ Petition is hereby disposed of, reserving liberty to the petitioners to make representation to the concerned authorities and seek regularization of the building constructed. If such a representation is made, the authorities concerned shall consider the same in accordance with law and pass appropriate orders. - 5 - HC-KAR NC: 2026:KHC:14510 WP No. 6536 of 2026 5. The respondents are hereby directed not to precipitate the matter against the petitioners for a period of three (03) months from today. The petitioners shall not put up any additional construction till an appropriate decision is taken by the authorities concerned on the application to be made by them.
