1. The petitioner’s application for transfer has been considered and tacitly rejected, not because the petitioner is ineligible but because the petitioner’s application ranks rather low in the first two of the three preferred schools. However, insofar as the third preferred school is concerned, the petitioner is the second waitlisted candidate. The first candidate, respondent no. 9 herein is also awaiting an appointment on transfer to the third preferred school of the petitioner.
2. In view of the aforestated, I direct the respondent no. 5 or his duly appointed representative to consider the applications on the basis of the inter se merit between the petitioner and respondent no. 9. This order is subject to the availability of the vacant seats in the said preferred school of the petitioner. The entire exercise should be completed by June 30, 2026.
