CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE CHALLA GUNARANJAN DATE : 15th September, 2026. Present : Advocate for Petitioner: Mr. K. Rama Koteswara Rao Advocate for Respondent: Mrs. Sushma Yaganti LISA GILL, CJ.
Learned counsel for respondent submits that representation dated 03.02.2025 of petitioner has been decided on 03.08.2026. Copy of same, furnished in Court today, is taken on record, subject to just exceptions.
2.
Learned counsel for petitioner submits that issue at hand has not been properly addressed, i.e., actual physical possession has not been handed over.
3. We take note of fact that violation of order dated 03.12.2025 is alleged. Vide said order, W.P. (PIL).No.90 of 2025 was disposed of with a direction to District Collector, Guntur District, to consider representation dated 03.02.2025, a copy of which would be submitted again by petitioner before District Collector and that an appropriate decision be taken preferably within a period of three (3) months and outcome intimated to petitioner or his counsel.
HCJ & CGRJ CC_2388_2026
4. Petitioner's representation has admittedly been decided by detailed
order dated 03.08.2026, whereby Tahsildar, Duggirala Mandal, has been
directed to handover advance possession of land, to the extent as mentioned therein, to authorities concerned of Panchayat Raj Department, subject to condition mentioned in said order and further to furnish certificate of handing over of land to District Collector, Guntur. However, Tahsildar has been
directed not to make any changes in Adangal or any other revenue records in favour of Department until final orders are received from Government on respective transfer proposals.
5. In this view of matter, we do not find any justification for continuation of present proceedings on the assertion that actual physical possession has not been handed over till date.
6. Keeping in view facts and circumstances as above, Rule is discharged. Contempt Case is closed with liberty to petitioner to avail such remedy/remedies as may be available, in respect of any subsisting grievance.
No costs. Pending miscellaneous application(s), if any, also stand(s)
disposed of accordingly.
