Singh, Advocate Mr. Sharon Toppo, Advocate -------- Order No. 6 /Dated: 3rd February 2026 The instant writ application has been preferred by the petitioner for the following reliefs: “1. i) For issuance of direction upon the respondents No.2 and 3 for making payment of due salaries of the petitioner for the post of Demonstrator in Botany, for which, the petitioner submitted several representations before the Respondents No.2 and 3 (Annexure 3 and 5). ii) For issuance of further direction upon the respondents to grant promotion to the petitioner on the post of Lecturer in Botany, pursuant to the order and direction of the Hon'ble Apex Court passed in Civil Appeal No. 4215-10 of 2002, arising out of S.L.P. No. 7021 and 2022 of 1999 (Annexure 1). And/Or For the issuance of any other writ(s)/Order(s)/direction(s) as to Your Lordships may deem fit and proper in the facts and Circumstances of this case, for doing conscionable justice to the petitioner.” 2. During course of hearing several affidavits have been filed by both the parties. 3. Learned counsel for the petitioner submits that the instant writ application may be disposed of by giving liberty to the petitioner to raise his grievance with regard to prayer made in this writ application before the 2026:JHHC:2839 2 Binod Bihari Mahto Koylanchal University which is a newly constituted University. 4. Learned counsel for the respondents does not raise objection. 5. Even though Binod Bihari Mahto Koylanchal University is not a party-respondent in this case; however, instead of issuing notice and delaying the matter further, interest of justice would be sufficed by giving liberty to the petitioner to approach the newly constituted University. 6. Accordingly, the petitioner is at liberty to prefer an application before the Registrar, Binod Bihari Mahto Koylanchal University within a period of six weeks from the date of receipt of copy of this order and if any such representation/application is preferred by the petitioner within the aforesaid stipulated period, the same shall be disposed of in accordance with law and applicable rules and regulations and necessary benefits, if any, shall be extended to the petitioner within a further period of eight weeks. 7.
