Petitioner has filed this petition under Article 226 of the Constitution of India seeking following reliefs: “9. Relief Sought. (I). Issue an appropriate writ, order, or direction, to the respondent authorities, particularly the concerned Revenue Inspector/competent revenue officials, to forthwith comply with the orders passed by the Nazul Officer, Ambikapur, and to conduct demarcation and submit report as directed. (ii). Direct the respondent authorities to prepare and submit the inquiry/report strictly in of the orders dated 31.12.2021 and subsequent directions, within a fixed and time-bound period as may be deemed fit by this Hon'ble Court; (iii). Direct that the statutory proceedings pending before the i.e Revenue case no. Nazul Officer, Ambikapur, 202601021200001/2025-26 pending before Nazul Officer, Ambikapur, District Surguja (C.G) be proceeded with expeditiously upon submission of the report, without being prejudiced by the respondents' prior inaction. 10. That, this Hon'ble Court may kindly be pleased to grant any other relief(s), which is 3 deemed fit and proper in the aforesaid facts and circumstances of the case.” 2. Learned counsel for the petitioner submits that petitioner has moved an application for correction of revenue records in respect of plot bearing No.1893/4777 (area 1.62 acres of land) situated at DC Road, Ambikapur, (CG) which is pending for consideration, hence, a direction be issued to the concerned respondent-authority to conduct the site inspection and, thereafter, submit the inspection report alongwith panchnama of aforesaid land before before the Court of Nazul Officer, Sarguja, Chhatiisgarh. 3. Learned State Counsel submits that time and again adjournments shall be taken either by the parties or by the Court or by the concerned officers and reports as sought for by the respondent/Nazul Officer, Amibkapur is still awaited. 4. Heard learned counsel for the parties and perused the material/records enclosed with this petition. 5. Considering the facts of the case, nature of reliefs, submission of counsel for the parties, particularly the fact that reports as sought for by respondent/Nazul Officer, Amibkapur is still awaited, further considering that the matter is lying pending since the year 2021, order-sheets goes to show that the first application was filed way back on 03.03.2021 and till date it has not been considered and decided, the instant petition stands disposed of directing the concerned Nazul Officer to call for the records expeditiously and decide the matter of petitioner within a period of 60 days from the 4 date of receipt of copy of this order in accordance with relevant rules/law, after giving due opportunities to the respective parties.
