CHIEF OFFICER, PUSAD, YAVATMAL AND ANOTHER VERSUS SHIVAJI S/O SAMBHAJI WAIKULE AND OTHERS Office Notes, Office Memoranda of Coram, Appearances, Court's orders or directions and Registrar's orders Court's or Judge's orders Mr. P.P. Deshmukh, Advocate for Petitioners. Mr. S.S. Ansari, Advocate for Respondent Nos.1 & 2. CORAM : NANDESH S. DESHPANDE, J. DATED : 21st SEPTEMBER 2026 1. This is an application filed by respondent Nos.1 and 2, seeking direction to the petitioner to deposit the awarded amount. 2. My attention has been drawn to the judgment passed by this Court in the subject writ petition, which was dismissed vide judgment dated 17.02.2026. Mr. Ansari, learned Counsel for respondent Nos.1 and 2 contends that a direction in terms of prayer clause ‘a’ be issued. 3. Mr. Deshmukh, learned Counsel appearing for the original petitioner i.e. Municipal Council, Pusad, submits that a review petition against the said judgment is already preferred and same is under consideration. He, therefore, submits that such a 2026:BHC-NAG:12546 2 2. WP 1568 of 2025.odt direction as prayed in the application cannot be granted. 4. However, the fact remains that there is a judgment rejecting the writ petition of the petitioner herein and therefore, it would be appropriate to direct the said petitioner i.e. Municipal Council, Pusad, to deposit the awarded amount to safeguard the interests of each and everyone. The civil application is, therefore, allowed and the petitioner i.e. Municipal Council, Pusad is directed to deposit the entire amount in this Court, awarded under the judgment passed by the learned Industrial Court, together with accrued interest within a period of six weeks from today. 5. In view of the above, the civil application is disposed of. (NANDESH S. DESHPANDE, J.) asd
