Y V RAVI PRASAD The Court made the following: 3 VS,J WP.No.19795 of 2012 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “....to issue writ of Mandamus or any other appropriate writ or order or direction declaring the action of respondents in not issuing Donor Passes pursuant to the proceedings in RoC.No.A/48A/102231 CA0/2009, dated 07.09.2009 as arbitrary and illegal, and consequently direct the respondents to issue Donor Passes in the name of the petitioner….” 2. The case of the petitioner is that, initially, one Smt. B. Indira, the mother of the petitioner, was allotted cottage No.10, SPT, Tirumala during her lifetime, as she donated an amount of Rs.5,00,000/- under the Cottage Donation Scheme with privileges, entitling her to use the said cottage for 60 days in a financial year. An agreement dated 31.01.1997 was executed to that extent between the petitioner’s mother and the 1st respondent; as per clause 5 of the said agreement, the privileges shall be in force and effective during lifetime of donor, donor’s spouse and the 1st legal heir of the donor. 3. After the death of the petitioner’s mother on 21.06.2008, the petitioner submitted a representation dated 09.07.2009 to the respondents requesting to consider him as the legal heir of Smt. B. India and to permit him to avail the privileges as the donor’s son during his lifetime. The said representation was considered by respondent No.1, who accordingly issued proceedings dated 07.09.2009, directing the Assistant Executive Officer, RI, Tirumala Tirupati Devasthanams, Tirupati to arrange entries in the computer and connected registers, send donor slips to the petitioner, honour them and 4 VS,J WP.No.19795 of 2012 report compliance. Aggrieved by the action of the respondent authorities in not issuing donor passes in his favour, pursuant to the proceedings dated 07.09.2009, the petitioner filed the present writ petition is filed. 4. Perused the entire material available on record. Today, when the matter came up for hearing, the Sri C. Srinivasa Baba, learned Standing Counsel representing the respondents furnished online entries of donor pass, pertaining to Cottage No.10, which discloses that the petitioner has been availing the privilege of using cottage No.10, SPT, Tirumala for 60 days in a financial year and in pursuance of issuance of donor slips, the said cottage has also been allotted to one Poolapally Ravinder Reddy on 09.09.2026 by the petitioner. The said fact discloses that the proceedings dated 07.09.2009 have been implemented by the respondents. 5. In view of the same, this Court is of the opinion that no further orders are necessary in the present writ petition. Accordingly, this writ petition is closed. There shall be no order as to costs.
