Consequently directing the respondents to disburse the sanctioned amount of Rs. 2,63,842/- /- together with interest thereon @ 18percent per annum from 31.05.2021 (sanctioned on 10.01.2023) till the date of payment by allowing the writ petition IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to directing the respondents to disburse the sanctioned amount of Rs. 2,63,842/- together with interest thereon @ 18% per annum from 31.05.2021 (sanctioned on 10.01.2023) till the date of actual payment pending disposal of the writ petition Counsel for the Petitioner: 1. GP FOR SERVICES I The Court made the following: 3 ORDER: The present Writ Petition is filed questioning the inaction of respondents in disbursing the sanctioned amount of Rs.2,63,842/-, vide Rc.No.3160/ A5/2022, dated 10.01.2023 issued by the respondent No.3, as illegal and arbitrary. 2. The petitioner was appointed as a Secondary Grade Assistant vide proceedings dated 17.08.2000 in A.B.M. U.P. School, Lambadipeta, Vijayawada, and retired from service as Secondary Grade Teacher in the said school on attaining the age of superannuation on 31.05.2021. The respondent No.4 had submitted a proposal for encashment of petitioner’s Half Pay Leave and Earned Leave vide Lr.RC.No.507/2022, dated 12.09.2022, to the 3rd respondent. In turn, respondent No.3, after verification of the proposal, issued proceedings vide Rc.No.3160/A5/2022, dated 10.01.2023, in the following terms: i. Rs.59,594/- towards encashment of 30 days Earned Leave; and ii. Rs.2,04,248/- towards encashment of 240 days Half Pay Leave – aggregating Rs.2,63,842/- (Rupees Two Lakhs Sixty-Three Thousand Eight Hundred and Forty-Two only). In spite of the same, the sanctioned amount was not disbursed to the petitioner. 3. Learned Government Pleader for Services-III submits that the delay in non-payment of the sanctioned amount would be examined by the 4 authorities and that the respondents would ensure that the said amount is disbursed to the petitioner as expeditiously as possible. 4. Considering the submissions, as respondent No.3, vide proceedings dated 10.01.2023, had sanctioned an amount of Rs.2,63,842/- (Rs.59,594/- towards encashment of 30 days Earned Leave and Rs.2,04,248/- towards encashment of 240 days Half Pay Leave), the delay in disbursing the same cannot be sustained. 5. Therefore, the Writ Petition is disposed of, directing the respondents to verify and disburse the amount due to the petitioner, along with applicable interest, within a period of eight weeks from the date of receipt of a copy of this order.
