This contempt petition under Section 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India has been AVANISH KUMAR PATHAK Digitally signed by AVANISH KUMAR PATHAK Date: 2026.05.05 12:13:51 +0530 2 preferred by the petitioner for non-compliance of order (Annexure C-1) dated 20-8-2024 passed in WPC No. 935/2023. 2. Learned counsel for the petitioner would submit that, in compliance of order (Annexure C-1) dated 20-8-2024 passed in WPC No. 935/2023, she filed a representation (Annexure P-2) before the respondent authorities, as directed by this court vide the order under contempt, despite that, her representation has not been decided yet. He further submits that, all the respondents, who were posted on said post while passing order dated 20-8-2024, have been changed, therefore, he submits that, this contempt petition may be disposed of granting liberty to the petitioner to file her representation before respondents No. 2 to 5 of the WPC No. 935/2023 and they may be directed to decide the same. 3. Learned counsel appearing for respondent No. 3 has no objection to allow above prayer. 4. Having considered aforesaid contention of learned counsel for the petitioner, since respondents of instant petition are not said to be posted on the said post as of now, therefore, prayer made by learned counsel for the petitioner is allowed. This contempt petition is disposed of granting liberty to the petitioner to file fresh representation before respondents No. 4 and 5 of WPC No. 935/2025, who are presently holding the said post, within a period of 15 days from today along with a copy of this order as well as order dated 20-8-2024 passed in WPC No. 935/2023. It is further observed that, in the event of filing aforesaid representation by the petitioner, the respondents No. 4 and 5 i.e. The 3 Executive Engineer, National Highway Division-cum-NHDP-PIU, Public Works Division, Bilaspur, Distt. Bilaspur and The National Highway Authority through the Project Director, Project Implementation Unit, Bilaspur shall decide the same within a further period of 45 days from the date of filing of the representation by the petitioner and if it is found that subject land of the petitioner has been utilized for construction of National Highway, then they may request the concerned Sub Divisional Officer (Revenue)/ Land Acquisition Officer for appropriate proceeding. 5. With the aforesaid observations and directions, this contempt petition is disposed of. 6. Accordingly, the rule issued to respondents is discharged and instant contempt proceeding is dropped.
