03/06.02.2026 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Chalkusa P.S. Case No.30/2025, registered for the offence under Sections 189(2), 189(4), 191(3), 126(2), 352, 118(1), 109(i), 303(2), 351(3) of the BNS, pending in the Court of the learned Judicial Magistrate, 1st Class, Hazaribagh.

Learned counsel appearing for the petitioners submits that the alleged date of occurrence is said to be of 05.06.2025, whereas, the FIR has been lodged on 10.06.2025. He further submits that the petitioner and informant side are neighbour. He then submits that the altercation took place due to grazing of crops of the informant by the cattle of the petitioners. He next submits that there are general and omnibus allegations of assault against all the family members. He also submits that in the injury report, it has come that there is abrasion and swelling at the right side of scalp.

Learned counsel appearing for the State opposed the prayer and

submits that the allegations are there of assault and pursuant to that grievous injury has been received by the son of the informant.

Looking into the contents of the FIR, it transpires that the direct allegation of assault is there against petitioner no.2, namely, Anil Saw and pursuant to the said assault, injury has been received by the son of the informant and in that view of the matter, I am not inclined to extend the privilege of anticipatory bail to petitioner no.2, namely, Anil Saw and, as such, his prayer for anticipatory bail is, hereby, rejected.

So far as petitioner nos. 1, 3, 4 and 5 are concerned, there is general and omnibus allegation of assault against them and all family members have been made accused and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to petitioner nos. 1, 3, 4 and 5.

Accordingly, petitioner nos.1, 3, 4 and 5, namely, Inderadev Saw @ Indradev Saw, Krishna Saw, Deoki Devi @ Devki Devi and Sarswati Kumari @ Saraswati Devi respectively are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hazaribagh in connection with Chalkusa P.S. Case No.30/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
