ORAL ORDER
The petitioners are before this Court seeking the following prayers:
"a. Issue a Writ, Order or direction of appropriate nature quashing the registration of the case in Crime No.79 of 2024 registered at Women's Police Station-West Division, Bangalore, dated 26/08/2024, pending before 24th ACMM, Bangalore, as against the Petitioners herein who are arraigned as Accused Nos.1 to 4, for alleged offences which are made penal under Sections 498-A, 504, 506, 323 and 34 of the Indian Penal Code and under Sections 3 and 4 of the Dowry Prohibition Act, which is produced as ANNEXURE-"A"; AND/OR b. Pass such other Order/s as this Hon'ble Court may deem fit and proper in the ends of justice."
2. Heard Sri. Ajay Kadkol T, learned counsel appearing for the petitioners, Sri.Anoop Kumar, learned HCGP appearing for respondent No.1, Sri.Paras Jain, learned counsel appearing for respondent No.2 and have perused the material on record.
3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows:

“AFFIDAVIT IN SUPPORT OF THE INTERLOCUTORY APPLICATION FILED UNDER SECTION 320 READ WITH SECTION 482 OF THE CODE OF CRIMINAL PROCEDURE
We, Bhavesh Kumar Barlota, S/o Prakash Chand Barlota, Aged About 30 Years, Resident Of No. 103, 1st Floor. N R Shree Glitz, 1st Cross, 3rd Main Road, the First Petitioner above named; and Chamarajpet, Bangalore -560 018 Ms.Ruthika P. D/o Late Pawan Kumar Chajjed, Aged About 31 Years, No.16, Maigunda Deva Mudliar Road, Frazer Town, Bangalore-560005 - the Second Respondent herein do hereby solemnly affirm and state on oath as follows:
1. I Bhavesh Kumar Barlota, am the First Petitioner in the above case, I am conversant with the
facts of the case and as such I am swearing this affidavit out of my own free will and volition. 2. I am swearing to this affidavit on behalf of the other Petitioners since there is no conflict of interest between us in relation to the reliefs sought for in the present Application. 3. I, Ms. Ruthika P., am the Second Respondent in the above case. I am conversant with the facts of the case and as such I am swearing this affidavit out of my own free will and volition. 4. The Impugned proceedings pertain to a matrimonial dispute which was pending inter se between the Petitioners herein and the Second Respondent herein. 5. The dispute between the Second Respondent herein and the Petitioners herein has been amicably resolved through mediation before the BangaloreMediation Centre, pursuant to which a decree of divorce came to be passed by the III Addl. Prl. Family Judge, Bangalore on 02.03.2026 in M.C. No.3336 of
2025. 6. In terms of the settlement recorded before the Mediation Centre, the First Petitioner and the Second Respondent herein have returned all jewellery and other belongings which were in the custody of each other, and have further stated that they have no claims whatsoever,

of any nature, against each other. The First Petitioner herein has also returned the Passport of the Second Respondent herein which was in his custody. 7. Further, in terms of the said settlement, the Second Respondent herein has agreed to co-operate for the quashing of the proceedings impugned in the present Writ Petition. The First Petitioner herein also undertakes to withdraw the PCR bearing No. 1760 of 2026 which is presently pending before the V Addl. Chief Judicial Magistrate, Bangalore City in its entirety against all the Accured named Herein. 8. As such, the Second Respondent herein does not wish to contest this matter any further in view of the amicable settlement having arrived at between the parties. 9. The Parties undertake not to file any case, complaint or application before any court or forum in relation to the dispute which forms the subject matter of the Impugned proceedings. 10.
In view of the amicable resolution of the dispute arrived at between the Second Respondent and the Petitioners herein, the proceedings in CC No. 43069 of 2024 pending on the file of the XXIV Addl. Chief Judicial Magistrate, Bangalore City qua the First Petitioner herein, and the case in Crime No. 79 of 2024 registered by the First Respondent Police qua the Petitioners Nos. 2 to 4 herein, beg for being quashed as against the Petitioners herein at the hands of this Hon'ble Court. We, therefore, request this Hon'ble Court to order the quashment of the proceedings in CC No. 43069 of 2024 pending on the file of the XXIV Addl Chief Judicial Magistrate, Bangalore City, in which case the Petitioner No.1 herein is arraigned as an Accused for the alleged commission of the offenses made penal under Sections Sections 498-A, 504, 506, 323 and 34 of the Indian Penal Code and under sections 3 and 4 of the Dowry Prohibition Act, and the case in Crime No. 79 of 2024 registered by the First Respondent Police in which the Petitioner Nos. 2 to 4 herein are arraigned as Accused Nos.2 to 4 respectively for the alleged commission of

offences made penal under Sections 498-A, 504, 506, 323 and 34 of the Indian Penal Code and under sections 3 and 4 of the Dowry Prohibition Act., in the ends of justice.”
4. The parties to the lis are present before this Court and are identified by their respective counsels. 5. During the subsistence of the subject petition, in the light of no interim order subsisting against the husband, it transpires that the police have filed the charge sheet before the concerned court against the husband in C.C.No.43069/202. 6.
In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and the affidavit and terminate the proceedings against the petitioners in the subject petition. 7. For the aforesaid reasons, the following:
ORDER i. Writ Petition is disposed.

ii. Proceedings in Crime No.79/2024 pending before the 24th Addl. Chief Metropolitan Magistrate, Bengaluru, stands quashed qua the petitioners. iii. In the light of the settlement arrived at between the parties, all proceedings in C.C.No.43069/2024 pending before the 24th Addl. Chief Judicial Magistrate, Bengaluru, stands quashed qua petitioner No.1.
