JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 and 2 are before this Court calling in question registration of a crime in Crime No.344/2025, pending before the 39th Additional Chief Metropolitan Magistrate, Bengaluru, for the offences under Sections 318(4), 351 and 352 of the BNS, 2023. 2. Learned counsel for the petitioners and respondent No.2 would in unison submit that during the subsistence of - 3 - HC-KAR NC: 2026:KHC:17680 CRL.P No. 4109 of 2026 these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed an application under Sections 357 of the BNSS, 2023 along with a joint affidavit before this Court to that effect. 3. The application reads as follows: “02. We submit that, the above petition has been preferred by the deponent No 1, herein praying this Hon'ble Court be pleased to pass the order quash the entire proceedings of the case in Crime No.344/2025 pending on the file of the Learned XXXIX Addl. Chief Metropolitan Magistrate, At Bangalore for the offence punishable under Sections 318(4), 351, 352 of BNS. 03. I, the deponent No 2 submit that, on my statement the entire case was built up, in view of the Compromise between the parties it is not inclined to prosecute the above case, accordingly is supporting the case of the prosecution, thereby the chances of conviction of the petitioners are very bleak and no useful purpose is likely to be served by allowing a criminal prosecution to continue. 04. I the deponent No 2 herein submits that, I entered in to this compromise on my own will and volition. There is no threat or cohesion by anybody. 05. We submit that, if this Hon'ble Court is not pleased to permit us to compound the above case, we will suffer irreparable loss and great hardship. Hence it is just, necessary and expedient to allow the annexed application as prayed for to secure the ends of justice.” - 4 - HC-KAR NC: 2026:KHC:17680 CRL.P No. 4109 of 2026 In the light of the afore-quoted joint affidavit filed along with the application, I deem it appropriate to terminate the proceedings against the petitioners, as the dispute and the allegations are between the individuals and not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The impugned crime in Crime No.344/2025, pending before the 39th Additional Chief Metropolitan Magistrate, Bengaluru, qua the petitioners, stands quashed.
