Since common questions of facts and law are involved in these petitions, therefore, these are being heard and decided together. However, for the sake of brevity and convenience, facts of Writ Petition (MS) No. 610 of 2023, alone are being considered and discussed. 3. Petitioner’s request for caste certificate was turned down by Tehsildar, Gadarpur, District Udham Singh Nagar vide order dated 16.01.2023. Thus feeling aggrieved, petitioner has approached this Court. The ground for rejection indicated in the impugned order is that Halka Lekhpal had given adverse report against the petitioner. 4. Learned State Counsel points out that UKHC010033632023 2026:UHC:7192 petitioner had claimed certificate certifying that he belongs to Other Backward Class of Uttarakhand State. He submits that validity of OBC caste certificate is only three years and the certificate, if issued in 2023, would have lost its validity in 2026 upon expiry of three years. Thus he submits that the reliefs claimed do not survive. 5. Having regard to the facts of the case, writ petitions are disposed of with liberty to petitioners to make separate fresh application for caste certificate. 6. If petitioners move such application with all supporting documents, the Competent Authority shall examine their claim and pass appropriate order, as per law, within eight weeks of receiving such application.
