Digitally signed by JYOTI JHA Date: 2026.05.05 17:16:16 +0530 2 Hon'ble Shri Justice Sachin Singh Rajput, Order on Board 04.05.2026 1) The present MCC has been filed seeking restoration of WPS No. 506/2021, which was dismissed on account of a peremptory order passed by this Court on 11.02.2021. 2) The Registry, in its noting dated 22.03.2021, dismissed the writ petition in compliance with the order dated 11.02.2021. Thereafter, MCC No. 357/2021 was filed by the applicants for restoration of WPS No. 506/2021 after a lapse of about two years. This Court, vide order dated 18.08.2023, allowed MCC No. 357/2021 and directed restoration of WPS No. 506/2021 to its original number. The applicants were further directed to rectify the defects as pointed out by the Registry within a period of six weeks, failing which the said order would lose its efficacy. As the applicants failed to remove the defects and did not comply with the order dated 18.08.2023, WPS No. 506/2021 could not be restored. 3) Learned counsel for the applicants submits that one last opportunity may be granted to remove the defects and that WPS No. 506/2021 be restored to its original number. 4) Learned State Counsel opposes the submission and submits that the defects were pointed out by the Registry in the year 2021 and, despite lapse of almost five years, the applicants have failed to remove the same. 5) It is also noted that one indulgence had already been granted by this Court in the year 2023, and after a lapse of nearly 2.5 3 years, the present application has been filed again seeking restoration of the writ petition. 6) Be that as it may, considering the submissions made by learned counsel for the parties and taking into account the conduct of the applicants who, despite lapse of about five years, have failed to remove the defects, particularly when this Court had granted six weeks’ time on 18.08.2023 and the defects still remain unrectified, this Court is not inclined to allow the present application.
