UKHC010147652026 2026:UHC:7555-DB IN THE HIGH COURT OF UTTARAKHAND AT NAINITAL THE HON’BLE CHIEF JUSTICE MR. MANOJ KUMAR GUPTA AND THE HON’BLE JUSTICE MR. SUBHASH UPADHYAY SPECIAL APPEAL NO. 356 of 2026 21st August, 2026 Kundan Lal -----Appellant Versus State of Uttarakhand and others ----Respondents Presence:- Mr. Vinoda Nand Barthwal, learned counsel for the appellant. Mr. Amrinder Pratap Singh, learned Additional Advocate General, assisted by Mr. J.C.Pande, learned Standing Counsel for the State. JUDGMENT : (per Mr. Manoj Kumar Gupta C. J.) 1. The present intra-court appeal is directed against the order of the learned Single Judge dated 11.08.2026, whereby Writ Petition (S/S) No. 2134 of 2026, filed by the appellant challenging his transfer order dated 31.07.2026, transferring him from Government Inter College, Langasi, Jyotirmath, Chamoli to Government Inter College, Sarnaul (Naugaun), Uttarkashi, on administrative grounds, has been dismissed. 2. The learned Single Judge has returned a specific finding that there were various complaints against the appellant and respondents after getting the complaints investigated and obtaining approval from the Officer, one rank higher, i.e., Director, School 1 UKHC010147652026 2026:UHC:7555-DB Education, Uttarakhand, transferred the appellant. Consequently, the learned Single Judge has declined to interfere with the transfer order. 3. Learned counsel for the appellant submits that the appellant has been transferred to a place, which is more than 362 Kilometers from the present place of posting. 4. In our opinion, the said fact itself would not invalidate the transfer order, which otherwise as per findings recorded by the learned Single Judge has been passed in total compliance of the statutory provisions. 5. Consequently, no case is made out to interfere with the order of learned Single Judge. 6. The appeal is accordingly dismissed. 7. Pending application, if any, also stands disposed of. (MANOJ KUMAR GUPTA, C. J.) (SUBHASH UPADHYAY, J.) Dated: 21.08.2026 Kaushal 2
