The Court made the following Order:
Heard the learned senior counsel for the petitioners, the learned Advocate General for the respondent Nos.1 to 5, the learned senior counsel for the respondent No.6 and the learned standing counsel for the respondent No.7. 2.
This writ petition is filed questioning the action of the respondent authorities in issuing Form-VII declarations vide Rc.G2/324/2025 (Gazette No.212) dated 23.12.2025 and Rc.G2/324/2024 dated 20.12.2025 under section 19(1) of the Act 30 of 2013 to acquire lands belonging to the petitioners herein without conducting personal hearing under section 15(2) and subsequent proceedings under section 16, 17 and 18 of the Act 30 of 2013 to acquire the lands belonging to the petitioners herein allegedly for industrial hub. 3. The learned counsel for the petitioners submits that the petitioners are the farmers and cultivating their lands to eke out their livelihood. The subject lands are fertile lands and the petitioners possess approximately a total extent of Ac.150.00 cents collectively. While so, in the third week of July, 2025, they noticed in the newspaper containing notifications vide Rc.G2/325/2025 and Gazette Notification Nos.72, 73, 74, 75 and 76 dated 19.06.2025. To their utter surprise, they came to know that the said notifications were issued by the Government stating that they need land for the purpose of industrial hub

and gave the land details and the pattadars of such lands. In fact, no officer came to their villages and asked their consent for giving their land for industrial hub and no Social Impact assessment was done. The said notifications were issued without Social Impact assessment as contemplated under Chapter II and III of the Act 30 of 2013. But the exemption itself is wrong and all the proceedings further are bad in law. The said notification was issued without revision and updating of market value as required u/s.26 of the Act 30 of 2013. Before issuing, revision must be done and this vitiates the whole exercise. A Grama Sabha was conducted on 04.07.2025 and the petitioners objected to give their agricultural lands and the same was recorded in the minutes book by the authority.
The petitioners reserve their right to challenge the validity of exemption from Chapter II and III and also the Sec.11(1) notifications separately. Their challenge to Sec.19(1) may not be construed as their acquiescence for Sec.11(1) notifications and other serious issues which go to root of the matter. 4. However, the petitioners gave their objections to the preliminary notification given by the respondent authorities. The preliminary notification contains the lands of the temples in their village and the interested parties to the deities filed writ petition challenging the high handed action of the respondent authorities for not taking permission of Hon’ble High Court to acquire the temple lands and the writ petition is

pending before the Division Bench of this Hon’ble High Court. The petitioners have been waiting for the public hearing so that their grievances/ objections can be submitted orally to the Acquisition Officer with the help of any educated persons, till date the public hearing notice is not given and the officers are forcing them to give their lands and threatening them with dire consequences. To their utter shock and surprise, the 2nd respondent issued a declaration vide Form-VII under section 19(1) of the Act 30 of 2013 vide Rc.G2/324/2025 (Gazette No.212) dated 23.12.2025 and Rc.G2/324/2024 dated 20.12.2025 without any enquiry and personal hearing under section 15(2) and all these were issued without conducting the social impact assessment and public hearing as contemplated under Act 30 of 2025 for the reasons best known to them. 5. The respondent authorities have to take decisions on the objections filed by them as per section 15(2) of the Act 30 of 2013. The respondent authorities have not given any opportunity for personal hearing on their objections.
The objections shall be made to the Collector in writing and the Collector shall give the objector an opportunity of being heard in person or by any person authorized by them in this behalf or by an Advocate and shall after hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in respect of the land which has been

notified under sub-section 11 of Act 30 of 2013. The petitioners were not given any notice of personal hearing, not heard and neither passed any report nor communicated any order rejecting their objections. The 2nd respondent does not even make any recommendations on the objections together with the record of the proceedings held by them or make any report giving therein the approximate cost of land acquisition particulars as to the number of affected families likely to be resettled. The social impact assessment is essential for land acquisition to develop industrial hubs. Chapter-III A will not be applicable as the industrial hub infrastructural project where public private partnership projects, when the land owned by the government the social impact assessment can only be exempted. However, the petitioners came to know that G.O.Ms.No.48 dated 25.03.2025 was issued which categorically states that the lands are being acquired to give the acquired lands to a private company for manufacturing solar panel modules. When the land is acquired for the purpose of handing over to the private companies, the basic ingredient of public purpose is defeated, on this ground alone the preliminary notifications and declaration shall be set aside. 6. The respondent authorities have not prepared the Rehabilitation and Resettlement Scheme of the project affected families. Section 16 of the Act 30 of 2013 categorically states that upon giving notification

under section 11(1) of the Act 30 of 2013, the respondent authorities shall conduct a survey and undertake a census of the affected families, ascertaining the lands and immovable properties being acquired, livelihoods lost, details of amenities and infrastructure etc. But the same was not followed u/s.16 of the Act 30 of 2013.
Without following the basic principle contemplated as per the law, the respondent authorities cannot proceed with issuing the declaration under section 19(1) of the Act 30 of 2013. The respondent authorities have to prepare a draft Rehabilitation and Resettlement Scheme as prescribed which shall include particulars of the rehabilitation and resettlement entitlements of each land owner and landless whose livelihoods are primarily dependent on the lands being acquired and where resettlement of affected families which has to include all the details of Rehabilitation and Resettlement. Upon drafting the Rehabilitation and Resettlement, the draft regulation has to be circulated in all the public places and public hearing has to be conducted by specifying the date, time and venue for the public hearing at the affected area. After completion of the Grama Sabha, the specific report on draft Rehabilitation and Resettlement Scheme has to be given and upon specific report the review is to be conducted and finally after completion of all the formalities the approved Rehabilitation and Resettlement Scheme has to be given. 16 BKM,J W.P.No.926 of 2026
7. The respondent authorities by-passed all the procedure contemplated in the Act 30 of 2013 and straight away given the declaration u/s.19(1) of the Act 30 of 2013. The rights of the petitioners are deprived by issuing the declaration without affording an opportunity of hearing. The petitioners gave their objections by way of representations to the respondent authorities and there must be an enquiry done for the objections raised by the petitioners and upon enquiry the respondent authorities have to pass proceedings whether considering or rejecting their objections. A report has to be made to the government and then orders need to be passed. Nothing was done by the respondent authorities and they have given preliminary notifications and waited for statutory period to complete and straight away gave the declaration u/s.19(1) of the Act 30 of 2013.
Further they are ready to give award enquiry notice at any time and if the authorities are allowed to proceed further and awards are passed, the petitioners will be displaced and then the officers will say go to the authority in appeal. 8. On the other hand, the learned Advocate General appearing for the respondent Nos.1 to 5 submitted that the land acquisition has been initiated strictly in accordance with the provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The 7th respondent filed a requisition before the 2nd respondent for the land in an extent of Ac.8214.30 cents

for establishment of industrial hub in the limits of Karedu Village of Ulavapadu Mandal, SPS Nellore District. Then the 2nd respondent issued orders for publication of preliminary notification u/s.11(1) of the L.A. Act, 2013 to acquire an extent of Ac.4858.17 vide 5 preliminary notices through the District Gazettes 72, 73, 74, 75 and 76. The present declarations that have been impugned in the subject writ petition fall under the preliminary notification issued vide Gazette NOo.72 for acquisition of an extent of Acs.1345.85 vide Rc.G2/324/2025 dated 19.06.2026. The land covered in the present writ petition is part of the above said notification. It was published in SPSR Nellore District Gazette No.72 dated 19.06.2025 and it was also published in all modes of publication as envisaged in the Act. Further, notices were issued to the interested persons in Form VI-B calling for objections if any u/s.15(2) of the Act read with Rule 21 of the Act within a period of 60 days from the date of such publication. 9.
All the 1210 objections received against publication of preliminary notification were enquired into by giving personal hearing and detailed report was submitted to the District Collector, SPSR Nellore District vide Rc.No.C/221/2025 by the 5th respondent dated 19.09.2025 and the 2nd respondent issued orders vide Rc.No.G2/324/2025 dated 20.09.2025 over-ruling the objections and the matter was communicated to all the land owners vide Rc.No.C/221/2025 dated 20.09.2025 of the 5th

respondent (typographical error in the orders as “20.08.2025 instead of 20.09.2025”). Speaking orders were communicated to the residential addresses of the objectors by registered posts. As a sequel to the land acquisition process, the declaration in Form-VII in two spells i.e., Ac.44.99 cents vide Nellore District Gazette No.211 dated 20.12.2025 and another extent of Ac.26.39 cents vide Gazette No.212 dated 23.12.2025 u/s.19(1) of the Act, 2013 were published in the manner prescribed in the Act. Statutory procedures including Grama Sabha, service of notices, hearing of objections, passing of speaking orders and determination of compensation have been scrupulously followed. The petitioners, despite having participated in the process and some of them having given consent, filed the present writ petition by suppressing the material facts. 10. A Grama Sabha was duly conducted on 04.07.2025 at Karedu Village for the purpose of explaining the proposed Industrial Hub project to the local land owners and to the persons interested. The nature, extent, public purpose and benefits of the project were clearly explained to the villagers. Social Impact Assessment was lawfully exempted vide Govt.
of A.P. Revenue (Lands-VI) Department – Memo No.REV0LAND/85/2025-LANDS-VI, dated 13.06.2025 following due procedure, as industrial corridors and manufacturing zones fall under infrastructure projects, which are eligible for exemption in terms of

Section 2(1)(b)(iii) read with the relevant provisions of the Act and Government orders. The exemption was granted by the State Government and was duly published in the District Gazette No.70 dated
13.06.2025. During the Grama Sabha, the participants have represented that they got time to file their objections up to 18.08.2025 i.e., 60 days from the date of issue of preliminary notification and they have filed 1210 objections from the date of publication of the preliminary notification (19.06.2025) to 18.08.2025. 11. In fact, personal hearing of all the farmers/interested persons was held on 30.07.2025 at the office of the 4th respondent.
The farmers in a group have expressed that they were not willing to give their lands hence question of conducting enquiry of personal hearing regarding their objection does not arise. Though some people have explained the issues mentioned in the petition they refused to sign the attendance register and also refused to give statements. In those circumstances, personal hearing for others was postponed to subsequent dates i.e., from 03.09.2025 to 15.09.2025 in the office of the 5th respondent. All the people attended for the personal hearing during the above said dates were heard and their petitions were disposed in the form of speaking order. The petitioners who attended did not know the contents of the petition they had given, they only stated that they are not willing to give their lands at the consented compensation and requested for more compensation. All the objections contain the same matter except the name of the petitioner. Therefore, it is clear that the petitioners are motivated and encouraged by some individuals with vested interests who wanted to stall the land acquisition proceedings. In fact, the petitioners are rich farmers holding large extents of agricultural lands and they influenced some of the poor farmers and included them as petitioners. 12. All the objections were carefully considered, personal hearings were afforded on 30.07.2025 and from 03.09.2025 to 15.09.2025. The land owners, interested persons attended the hearing and requested to withdraw the notification on the ground that they do not want to give their lands to the government for establishment of industrial hub. The land owners who attended the hearing have refused to sign the attendance register and also not given any statement on their requests.
A detailed report was submitted to the 2nd respondent vide Rc.No.C/221/2025 dated 19.09.2025 regarding the objections filed u/s.15(2) and the 2nd respondent issued orders vide Rc.No.G2/324/2025 dated 20.09.2025 over-ruling the objections and the matter was communicated to all the land owners vide Rc.No.C/221/2025 dated 20.09.2025 of the 5th respondent (typographical error in the order as

Out of the total extent of Ac.1345.83 cents covered under preliminary notification-I issued on 19.06.2025 vide District Gazette No.72, 638 farmers covering an extent of Ac.922.75 cents (68%) have already given their consent, including the following 4 of the present writ petitioners viz., Kunam Venkareddy, S/o. Krishna Reddy (Sl.No.44 of the WP), Alla Venkata Ramana Reddy, S/o Chenchi Reddy (Sl.No.19), Alla Suvarchala, W/o Venkata Ramana Reddy (Sl.No.37), Savaram Eswaramma, W/o Venkatrao (Sl.No.51) and Kokkiligadda Subrahmanyam, S/o Venkateswarlu (Sl.No.22).
Out of the total extent of land that is to be acquired, horticultural crops are grown in an extent of about Ac.250.00 cents. The petitioners have Ac.20.00 cents of Mango and Banana orchards. The farmers who own an extent of Ac.202.00 cents of orchard crops have already given their consent for the land acquisition as per the compensation fixed by the negotiations committee. Therefore it is clear that most of the farmers who grow

horticultural crops have already given consent for land acquisition and compensation has also been paid to them. 14. As stated supra, pursuant to the requisitions submitted by the 7th respondent, preliminary notifications were issued vide Rc.No.G2/325/2025 published through District Gazette Nos.72, 73, 74, 75 and 76 of SPSR Nellore District notifying a total extent of Ac.4858.15 cents on 19.06.2025 for establishment of the industrial hub. A Grama Sabha was also conducted on 04.07.2025 at Karedu Village and minutes of the Grama Sabha are also enclosed. The project is conceived under the aegis of the National Investment and Manufacturing Zones (NIMZ) / Industrial Corridor concept. The location of the project has been strategically selected considering its proximity to Ramayapatnam Port, National Highway-16 and availability of local stream facilitating inland water usage, making it eminently suitable for industrial development. As a matter of fact, no other land that is suitable for the project is available and after giving much deliberation only the subject land is selected by the government. As already stated, Social Impact Assessment was exempted by Government orders published in District Gazette No.70 dated 13.06.2025 strictly in accordance with law. 15. The revision of market value was completed in January 2025 by the District Level Committee prior to the issuance of the preliminary

notification.
The petitioners themselves have admitted that the Grama Sabha was conducted on 04.07.2025 in their village and the content of the preliminary notification issued to acquire lands was informed in the Grama Sabha and that itself reveals that the provisions of the Act are followed and that the farmers availed the opportunity of filing their objections. Having participated in the statutory process, the petitioners cannot now turn around and allege violation of procedure. All statutory norms and provisions under the Act have been strictly complied with. There was no coercion, intimidation or threat exercised at any point of time. The fact is that out of Ac.1345.83 cents of land published for acquisition vide District Gazette No.72 dated 19.06.2025, the land owners covering an extent of Ac.922.75 that is about 68% of the farmers have given their consent which indicates that the farmers are coming forward to give their land for industrial purpose. Only some of the persons holding large extents of land, with an intention to stall the proceedings and to demand higher compensation by dubious means are resorting to raise false litigation. 16. Similarly, the learned counsel for the 6th respondent relying upon the counter of the 6th respondent sailing with the other respondents submitted that certain writ petitioners including Kaliki Ramana Reddy and Boddu Gopala Reddy have already initiated parallel proceedings before the National Green Tribunal, Southern Zone, Chennai, raising

substantially identical grievances relating to the very same project. Sri K.Malakonda Reddy has instituted Original Application No.5 of 2026 before the National Green Tribunal, Chennai Bench, directly challenging the project and the allocation of land in favour of the 6th respondent. The petitioner Nos.9 and 47 in the present writ petition have also approached the said Tribunal by filing applications seeking directions in relation to environmental clearances and project approvals pertaining to the very same project.
The petitioner Nos.1, 15 and 39 have earlier approached this Hon’ble Court by filing W.P.No.21466 of 2025 seeking a declaration that the action of the respondent authorities in initiating the process to take over the lands belonging to respondent temples to an extent of Ac.104.21 cents situated in Karedu Village, Ulavapadu Mandal, SPSR Nellore District, in the name of industries without obtaining prior permission of this Hon’ble High Court is illegal and arbitrary. A significant number of petitioners in the present writ petition are also parties in the said earlier proceedings. The institution of multiple proceedings before different forums on overlapping issues clearly reveals a concerted attempt at forum shopping and abuse of judicial process, the sole objective of which is to stall and frustrate the implementation of the project. 17. All mandatory procedures prescribed under the RFCTLARR Act, 2013 were meticulously followed, including issuance of preliminary

notification, service of statutory notices, conduct of Grama Sabha, invitation and consideration of objections and issuance of reasoned and speaking orders by the competent authority. The project in question is expected to generate substantial employment opportunities and regional economic development, which constitutes a recognized public purpose under the RFCTLARR Act, 2013. It is in public domain that a Grama Sabha was duly convened on 04.07.2025 during which the nature, scope and benefits of the project were explained to the villagers. Statutory notices were also duly issued inviting objections from affected land owners. The State Government, in exercise of powers under Section 10A of the RFCTLARR Act, 2013, lawfully granted exemption from SIA requirements, as the project falls within the category of infrastructure/industrial corridor projects. The exemption was duly notified and published in the District Gazette. All the land is not for the purpose of indosol, but also for other industries, ancillary companies, common infrastructure and such other activities. 18.
The public domain information provides that personal hearings were conducted on 30.07.2025 and between 03.09.2025 and 15.09.2025 during which period the objections raised by the land owners were duly considered. The objections received were duly examined, a detailed report was submitted by the Land Acquisition Officer and the District Collector passed reasoned and speaking orders

before issuance of declarations. It is well settled that industrial development, infrastructure creation and large scale employment generation constitute legitimate public purposes, particularly in projects of national significance. The acquisition does not result in displacement of any project affected families and therefore the statutory requirement of preparation of R&R scheme does not arise. All procedures mandated under the RFCTLARR Act were strictly complied with in letter and spirit. The petitioners have effective and efficacious alternative remedies available under the statutory framework and the same seems to have already been availed by the petitioners, which renders invocation of writ jurisdiction inappropriate. As already stated, proceedings are pending before the National Green Tribunal and certain petitioners are parties to those proceedings. The petitioners have therefore deliberately misled this Hon’ble High Court. 19. As many as 638 farmers encompassing approximately Ac.828-00 cents of land, have already voluntarily consented to the acquisition, including several of the present writ petitioners themselves, the overwhelming support extent by the vast majority of land owners clearly demonstrates that the opposition to the project is being orchestrated by a small minority with vested interests seeking to stall and derail a strategically important public infrastructure initiative for extraneous and ulterior motives, and the repeated institution of proceedings before

multiple forums, including this Hon’ble Court and the National Green Tribunal, further evinces a deliberate and systematic pattern of harassment, abuse of the process of law and impermissible forum shopping aimed at obstructing the timely implementation of the project.
The project is of paramount national and public importance as it strengthens India’s renewable energy manufacturing ecosystem, reduces dependence on imports for critical solar technology, generates thousands of employment opportunities and accelerates regional economic development. Any delay in implementation of the project would cause irreparable prejudice not only to the 6th respondent but also to the State of Andhra Pradesh and the nation at large, besides undermining national renewable energy goals. The present writ petition is wholly misconceived, devoid of merit, and not maintainable wither on
facts or in law. The petitioners have approached this Hon’ble Court with unclean hands by suppressing the material facts.

21. In view of the above said facts and circumstances, upon
consideration of the rival submissions made, on perusal of the material available on record and the citations referred, it is to be seen that once the objections are filed by the affected land owners, the same are required to be decided by the Collector u/s.15(2) of the Act, after giving an opportunity of being heard to the land owners, should submit their objections and after making further enquiry as the Collector may think necessary. He is required to submit his report to the appropriate forum for an appropriate action in the acquisition in question. Thus, it is mandatory on the part of the Collector to comply with the procedure u/s.15(2) of the Act so as to make the acquisition proceedings legal and in confirmity with the provisions of the Act. 22. However, the jurisdiction of the High Court under Article 226 of the Constitution is extraordinary, equitable and discretionary. Prerogative rights mentioned therein are issued for doing substantial justice. Hence, the petitioner must come with clean hands, put forward

all the facts before the Court without sealing or suppressing anything to seek appropriate relief. There shall be candid disclosure of relevant material facts otherwise they would be guilty of misleading the Court. 23. Considering the totality of the facts and circumstances of this case, as borne out from the material available on record, it is to be seen that it is the case of the petitioners that they gave their objections by way of representations to the respondent authorities concerned and there must be an enquiry to be done for the objections raised by the petitioners and upon enquiry, the respondent authorities have to pass proceedings either by considering or rejecting their objections, a report has to be made to the Government and then orders have to be passed. But nothing was done by the respondent authorities and they have given preliminary notifications and waited for statutory period completed and straight away given the impugned declaration u/s.19(1) of the Act 30 of 2013.
But as per the contentions of the respondent authorities, basing upon the records, notices were issued to the interested persons in Form VI-B calling for objections if any u/s.15(2) of the Act read with Rule 21 of the Act, within a period of 60 days from the date of such publication. All the 1210 objections received against the publication of preliminary notification were enquired into by giving personal hearing and detailed report was submitted to the 2nd respondent vide Rc.No.C/221/2025 of the 5th respondent dated 19.09.2025 and the 2nd

respondent issued orders vide Rc.No.G2/324/2025 dated 20.09.2025 over-ruling the objections and communicating the same to all the land owners vide Rc.No.C/221/2025 dated 20.09.2025 of the 5th respondent. Speaking orders were also communicated to the residential addresses of the objectors by registered posts. As a sequel to the land acquisition process, the declaration in Form VII in two spells i.e. Ac.44.99 cents vide Nellore District Gazette No.211 dated 20.12.2025 and another extent of Ac.26.39 cents vide Gazette No.212 dated 23.12.2025 u/s.19(1) of the Act, 2013 were published in the manner prescribed in the Act. Statutory procedures including Grama Sabha, service of notices, hearing of objections and passing of speaking orders etc. appears to have been scrupulously followed. Timelines and crucial dates relating to the land acquisition process undertaken as of now are shown in the above table covering dates between 06.04.2025 and
24.12.2025. The details of the notices served in Form VI-B u/s.15(2) of the Land Acquisition Act, 2013 are also referred in the above said table. 24. It appears that all the objections were considered, personal hearings were attended on 30.07.2025 and from 03.09.2025 to 15.09.2025, the land owners and the interested persons attended the hearing and requested to withdraw the notification on the ground that they do not want to give their lands to the Government for establishment of industrial hub. Somehow, the land owners appear to have refused to

sign the attendance register and not given any statement on their requests.
Consequently, a detailed report was submitted to the 2nd respondent vide proceedings Rc.No.C/221/2025 dated 19.09.2025 as stated above regarding the objections vide u/s.15(2) of the Act and the 2nd respondent issued orders vide Rc.No.G2/324/2025 dated 20.09.2025 over-ruling the objections and the matter was communicated to all the land owners vide Rc.No.C/221/2025 dated 20.09.2025 of the 5th respondent. Speaking orders were communicated to the residential addresses of the objectors by registered posts as shown in detail in the above said table. It appears that the location of the project has been strategically selected considering its proximity to Ramayapatnam Port, National Highway-16 and availability of local stream facilitating inland water usage, making it eminently suitable for industrial development. It appears that as many as 638 farmers covering an extent of Ac.922.75 cents approximately 68% of the land owners have already gave their consent, including some of the present writ petitioners. 25. For the foregoing reasons, it is clear that the respondent authorities have followed the due procedure as contended by the learned Advocate General appearing for the respondent Nos.1 to 5 in the matter of subject land acquisition till the stage covered under this writ petition, specifically with respect to the alleged violations on the

grounds raised by the petitioners herein. The procedure followed by the respondent-State as stated above, does not show any violation of Section 15(2) of the Act 30 of 2013 in the facts and circumstances of this case. When the State policy is being executed following the statutory provisions, the same cannot be interdicted raising false grounds to drag on the proceedings and frustrate the project at one stage or the other. Therefore, the impugned proceedings of the 2nd respondent dated 23.12.2025 and 20.12.2025 are sustainable and not liable to be interfered with. However, the respondent authorities are
directed to proceed with the further process of the subject land acquisition, strictly in accordance with law, giving due opportunity to the petitioners at appropriate stages, wherever it is warranted and the same shall be completed as expeditiously as possible.
26. Accordingly, this Writ Petition is disposed of. There shall be no
order as to costs. Interim order, if any, deemed to have been vacated.
