4. The instant petition is moved under Section 528 of BNS, 2023 by Mohd. Asif, son of Nanhe along with the compounding application for quashing of the entire proceedings of Criminal Case No. 2038 of 2022, wherein present applicant is facing trial for offences punishable under Section 323, 452 IPC.
5. Applicant and respondent no. 2 are present in the Court and they are duly identified by their respective counsel.
6. It is contended in the compounding application that both the parties have settled their dispute amicably and in fact, applicant is working with the husband of respondent no. 2 and they are old friends and now, they have resolved their dispute amicably, therefore, instant proceedings be closed.
7. On the other side, learned State Counsel submits that since now the informant herself does not want pursue the trial, therefore, there is no useful purpose to continue with the trial. He further submits that offence punishable under Section 323 IPC is compoundable except the offence punishable under Section 452 IPC but the same can be compounded with the leave of the

After hearing the learned counsel for the parties and taking into consideration that both the parties have resolved their dispute amicably and informant does not want to pursue with the trial court proceeding, therefore, there is no useful purpose to continue with the trial. In such view of the matter, compounding application i.e I.A. No. 1 of 2026 as well as instant C528 petition are allowed.
9. Consequently, entire proceedings of Criminal Case No. 2038 of 2022 (State Vs. Mohd. Asif), wherein present applicant is facing trial for offences punishable under Section 323, 452 IPC pending in the court of learned Addl. Chief Judicial Magistrate, Haldwani, District - Nainital is hereby quashed. (Rakesh Thapliyal, J.) 18.08.2026 SKS
