Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. By the present writ petition the petitioner seeks direction upon the respondent authorities to grant ‘A’ category scale of pay to the petitioner from the date of her appointment in the post of Assistant Teacher on and from 10th July, 2021. 3. The petitioner contends that she joined as Assistant Teacher with B.Ed. qualification in Dakshin Purusottampur Primary School under Pichhaboni Circle, Purba Medinipur on 10th July, 2021. The petitioner is yet to complete the bridge course. There are no such recognised bridge course institute in the State as of now. Hence this writ petition seeking for ‘A’ category scale of pay. 4. Mr. Abdur Rakib, learned Advocate appearing for the petitioner submits that in similar circumstances the court has directed for consideration of the prayer of the petitioner, therein, for ‘A’ category scale of pay in accordance with law. He seeks that similar direction. 5. Mr. Shamim ul Bari, learned Advocate appearing for the State submits that though the petitioner has filed an application raising her claim through her learned advocate, however, she has not filed any application on her individual capacity. However, the matter may be relegated to the appropriate authority for due consideration in the event such application is made. 6. In view of the aforesaid submissions, liberty is granted to the petitioner to file a comprehensive application before added respondent no.11, the Commissioner of School Education, Government of West Bengal raising her claim of ‘A’ category scale of pay within a period of four weeks from the date of this order. Upon such receipt of such application, the added respondent no.11, the Commissioner of School Education shall consider the application of the petitioner and dispose of the same by passing a reasoned order in accordance with law upon notice to the petitioner within a period of 12 weeks from the date of receipt of such application. 7.
Learned advocate for the petitioner is directed to communicate this order to the added respondent no.11, the Commissioner of School Education, Government of West Bengal for necessary action. 2
8. With the above direction, the writ petition being WPA 10104 of 2025 stands disposed of. 9. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 10. Interim order, if any, stands vacated. 11. All connected applications, if any, stand disposed of. 12. There shall be no order as to costs. 13. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 14. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.) 3
